Selectmen's Meeting Minutes 09/10/02
The Board of Selectmen held a special meeting on Tuesday, September 10, 2002 at Canaan House, Fairfield Hills, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 10:15 PM, directly following adjournment of the Fairfield Hills Master Plan Advisory Committee.

PRESENT:        First Selectman Herbert Rosenthal and Selectman William Brimmer.
           Selectman Joseph Bojnowski was unable to attend.
        

VOTER PARTICIPATION – None present

COMMUNICATIONS:  First Selectman Rosenthal advised that the National Security Council has increased the state of alarm to a Code Orange for tomorrow (September 11).  He has asked the Police Department to have officers at any community events.

ACCEPTANCE OF MINUTES:  Upon motion by Selectman Brimmer, the minutes of the 7/22/02 and 8/19/02 meetings were unanimously accepted as presented.

UNFINISHED BUSINESS

Sale of Properties (Pootatuck Park and Housatonic Heights)
A Town Meeting was held earlier this evening and the sale of .09 acres in Pootatuck Park and .11 acres in Housatonic Heights was approved.  As per the Town Charter, these properties will be sold by sealed bid.  The bidders will be required to pay for an A-2 survey and any legal costs required for the transfer of the property.

Capital Improvement Plan – This will be discussed at the next meeting.


NEW BUSINESS

Maintenance of Roads in Walnut Tree Village
First Selectman Rosenthal advised that residents of Walnut Tree Village had requested that the roads in Walnut Tree Village be maintained by the Town, as per the Ordinance that requires the Town to plow and sand all private roads with three or more residences.  Town Attorney David Grogins has submitted a written opinion that the P&Z Regulations classify condominium roads as “driveways” which are not plowed by the Town.  

Maintenance Bond Release, Road & Drainage Work Agreement, High Bridge Road, “Avalon” Subdivision
Selectman Brimmer moved to release maintenance bond for Road & Drainage Work Agreement, High Bridge Road, “Avalon” Subdivision in the amount of $2,200.  Motion seconded and unanimously carried.


Driveway Bonds
Selectman Brimmer moved to release four (4) driveway bonds as outlined on Attachment A.  Motion seconded and unanimously carried.
        Selectman Brimmer moved to release one subdivision bond as outlined on Attachment A.  Motion seconded and unanimously carried.
        Selectman Brimmer moved to approve six month extensions for two driveways as outlined on Attachment A.  Motion seconded and unanimously carried.
