MINUTES

SPECIAL MEETING OF THE TOWN OF NEWTOWN BOARD OF POLICE COMMISSIONERS HELD ON WEDNESDAY FEBRUARY 2, 2011

At 6:04 P. M., the meeting was called to order by Chair Person Duane Giannini. Present were Commissioners Brian Budd, James Viadero and Bruce Walzcak. Absent was Commissioner Keith Jacobs. Also present were Attorney Fred Dorsey, Chief Kehoe, Captain Rios, Officer Dana Schubert, Officer Michael McGowan and Detective Dan McAnaspie.  

The Commission was presented with the Personnel Report by Chief Kehoe.  Chief Kehoe reported that he had received a resignation request from Sergeant Domenic Costello effective January 21, 2011.  At 6:06 P. M., a motion was made by Commissioner Walczak to accept the resignation of Sergeant Costello effective January 21, 2011. The motion was seconded by Commissioner Budd and carried by unanimous vote.  

Chief Kehoe reported that he had received a resignation request from Officer Andrew Stinson effective February 2, 2011.  At 6:08 P. M., a motion was made by Commissioner Budd to accept the resignation of Officer Stinson effective February 2, 2011. The motion was seconded by Commissioner Walzcak and carried by unanimous vote.  

At 6:10 P. M. a motion was made by Commissioner Viadero to go into executive session for the purpose of discussion and possible action upon strategy and negotiations with regard to commencing a disciplinary action against an employee and to invite Board Attorney Monte Frank into executive session. The motion was seconded by Commissioner Budd and was carried by unanimous vote.

At 6:45 P. M. the Board came out of executive session.

At 6:52 P. M. attorneys Fred Dorsey and Monte Frank spoke by cell phone with Attorney Eric Brown who was representing Officer Dana Schubert.

A motion was made by Commissioner Walzcak to adjourn the meeting to Monday February 7, 2011 at 7:30 P. M. for the purpose of item 4:  “Discussion and possible action upon the discipline of Officer Dana Schubert”. The motion was seconded by Commissioner Budd and unanimously carried.

RE-ADJOURNMENT OF SPECIAL MEETING OF THE TOWN OF NEWTOWN BOARD OF POLICE COMMISSIONERS HELD ON MONDAY FEBRUARY 7, 2011

At 7:40 P. M., the meeting was re-adjourned by Chair Person Duane Giannini. Present were Commissioners Brian Budd, James Viadero, Keith Jacobs and Bruce Walzcak. Also present were Attorney Fred Dorsey, Chief Kehoe, Captain Rios, Attorney Monte Frank, and Attorney Eric Brown.

At 7:40 P. M. a motion was made by Commissioner Viadero to go into executive session for the purpose of discussion and possible action upon strategy and negotiations with regard to commencing a disciplinary action against an employee and to invite Board Attorney Monte Frank, Attorney Fred Dorsey, Capt. Rios and Chief Kehoe into executive session. The motion was seconded by Commissioner Budd and was carried by unanimous vote.

At 7:53 P. M. the Board came out of executive session.

A motion was made by Commissioner Walzcak to adjourn the meeting to the next scheduled regular meeting of the Board of Police Commissioners. The motion was seconded by Commissioner Jacobs and unanimously carried.
