Present:  Ms. Dean; Mr. Bloom; Ms. Bryner and Mr. Mulholland.  Alternates: Mr. Mr. Pozek seated for Mr. Poulin and Mr. Cruson. Clerk:  Ms. Wilkin

The meeting was opened at 7.31 p.m.  Notice is made that the entire meeting was taped and can be heard in the Planning and Zoning Office, Municipal Building, 3 Primrose Street, Newtown, Connecticut

PLAN OF CONSERVATION AND DEVELOPMENT AND LONG RANGE PLANNING

PRESENTATION BY LEGISLATIVE COUNCIL ADMINISTRATION COMMITTEE CHAIRMAN GARY DAVIS CONCERNING LONG RANGE PLANNING

The Commission discussed with Mr. Davis how the Legislative Council could assist with the Plan of Development.  They explained the process of how they plan to achieve their goal.

PUBLIC HEARING

APPLICATION BY TALON RIDGE BUILDERS LLC FOR AN AMENDMENT TO A SPECIAL EXCEPTION TO CONSTRUCT AN ADDITIONAL BUILDING OF 5,000 SQUARE FEET, 8 PECKS LANE, NEWTOWN, CONNECTICUT AS SHOW ON A CERTAIN MAP ENTITLED “IMPROVEMENT LOCATION SURVEY, DEPICTING COMMERCIAL BUILDINGS AT 8 PECKS LANE, NEWTOWN, CONNECTICUT PREPARED FOR TALON RIDGE BUILDERS” DATED JUNE 22, 2009. LAST REVISED 1/25/10, SCALE 1” = 40 ‘, ASSESSOR’S MAP 36, BLOCK 7, LOT 6

The hearing was opened at 7:55 p.m.

Ms. Brymer read the call for the meeting.

Ms. Dean read the correspondence in the file and asked to hear from the applicant.

Charles Spath, P.E., Trumbull, Connecticut explained the application.  The design will match the existing building.  Staff comments were addressed including the Conservation Commission’s query about outside lighting.

The hearing was closed at 8:22 p.m.

ACTION

Ms. Brymer moved the following:

BE IT RESOLVED by the Newtown Planning and Zoning Commission that the application by Talon Ridge Builders, LLC for an amendment to a special exception to construct an additional building of 5,000 square feet, 8 Pecks Lane, Newtown, Connecticut, as shown on a certain map entitled “Improvement Location Survey, Depicting Commercial Buildings, #8 Pecks Lane, Newtown, Connecticut Prepared for Talon Ridge Builders” dated June 22, 2009, last revised 1/25/10, scale 1” = 40’, Assessor’s Map 36, Block 7, Lot 6

SHALL BE APPROVED

BE IT FURTHER RESOLVED that the application is consistent with the purpose and intent of the town of Newtown Plan of Conservation and Development

BE IT FURTHER RESOLVED that the Commission finds that the application meets the standards and criteria for a special exception as set forth in Section II of the Zoning Regulations and the application to be consistent with the M-5 zone

BE IT FURTHER RESOLVED that this approval shall become effective on September 16. 2010

APPLICATION BY THE TOWN OF NEWTOWN PLANNING AND ZONING COMMISSION FOR A PROPOSED AMENDMENT TO THE ZONING REGULATIONS AT ARTICLE VIII, SECTION 8.01.610 TO ALLOW TEMPORARY POLITICAL SIGNS AS CONTAINED IN A CERTAIN DOCUMENT ENTITLED “PROPOSED AMENDMENT TO THE TOWN OF NEWTOWN ZONING REGULATIONS ADD REGULATION 8.01.62 TO SECTION 8.01.610 – ALL ZONES”, DATED JULY 22, 1010

The hearing was opened at 8:25 p.m.

Ms. Dean read the call for the hearing.  

The Commission discussed various documents sent by a member of the public who was present at the meeting.  It was decided not to proceed with the amendment at this time.

The hearing was closed at 8:45 p.m.

BE IT RESOLVED by the Newtown Planning and Zoning Commission that the application by the Town of Newtown Planning and Zoning Commission for a proposed amendment to the zoning regulations at Article VIII, Section 8.01.610 to allow temporary political signs as contained in a certain document entitled “Proposed Amendment to the Town of Newtown Zoning Regulations Add regulation 8.01.62 to Section 8.01.610 – All Zones”, dated July 22, 2010 and revised 8/5/10

PUBLIC HEARING (Continued)

APPLICATION BY HATTERTOWN LLC FOR A FIVE LOT SUBDIVISION, 22 & 24 HATTERTOWN ROAD, NEWTOWN, CONNECTICUT, AS SHOWN ON A CERTAIN MAP ENTITLED “FINAL SUBDIVISION MAP PREPARED FOR HATTERTOWN, LLC, NEWTOWN, CONNECTICUT: DATED MARCH 25, 2010, SCALE 1” = 60’, ASSESSOR’S MAP 8, BLOCK 9, LOTS 2 AND 2B

John McCoy, P.E., JFM Engineering, 440 Main Street, Ridgefield, Connecticut, engineer for the project submitted the requested report on an archeological study that was done.  He submitted a letter addressing staff comments, especially those of the Town Engineer.  

An abutter to the property had various questions regarding runoff, traffic and driveway locations.

Mr. McCoy and the Commission discussed the issues raised.

Ms. Dean requested a 35 day extension in order to go over the new information submitted.  The meeting will continue at the meeting of October 7, 2010.

APPLICATION BY THE TOWN OF NEWTOWN PLANNING AND ZONING COMMISSION FOR A PROPOSED AMENDMENT TO THE ZONING REGULATIONS AT ARTICLE III, SECTION I, SECTION 3.01.319 TO ALLOW INNS IN R-2 AND R-3 ZONES ON PROPERTIES OF TEN ACRES OR GREATER, AS CONTAINED IN A CERTAIN DOCUMENT ENTITLED “PROPOSED AMENDMENTS TO THE TOWN OF NEWTOWN ZONING REGULATIONS AMEND ARTICLE III, SECTION I – FARMING AND RESIDENTIAL ZONES” DATED JUNE 28, 2010

Ms. Dean asked to hear from the public.

Mary Curran, 41 Cold Spring Road, Newtown, Connecticut opposed the proposal.

After considerable discussion the Commission withdrew the application.
