Present:  Ms. Dean; Ms. Brymer; Mr. Mr. Mulholland.  Alternates  Mr. Porco seated in place of Mr. Bloom and Mr. Pozek. Also present:  George Benson, Land Use Director.  Clerk:  Ms. Wilkin

The meeting was opened at 7.37 p.m.  Notice is made that the entire meeting was taped and can be heard in the Planning and Zoning Office, Municipal Building, 3 Primrose Street, Newtown, Connecticut

PUBLIC HEARING

APPLICATION BY THE TOWN OF NEWTOWN PLANNING AND ZONING COMMISSION FOR A PROPOSED AMENDMENT TO THE ZONING REGULATIONS AT ARTICLE III, SECTION I, TO ADD APARTMENTS FOR FARM EMPLOYEES CARIING FOR HORSES, LOCATED IN A DETACHED BARN, ASSESSORY TO A SINGLE FAMILY DWELLING AS CONTAINED IN A CERTAIN DOCUMENT ENTITLED “PROPOSED AMENDMENT TO THE TOWN OF NEWTOWN ZONING REGULATIONS, ACCESSORY USES IN RESIDENTIAL ZONES ARTICLE III, SECTION 1, 3.01.500 – ACCESSORY USES” DATED MARCH 5, 2010

Ms. Dean read the call for the hearing and communications in the file.  The Commission was familiar with the application and expressed no objections.

Ms. Brymer moved the following:

BE IT RESOLVED by the Newtown Planning and Zoning Commission that the application by the Commission for a proposed amendment to the zoning regulations at Article III, Section 1 to add apartments for farm employees caring for horses, located in a detached barn, accessory to a single family dwelling as contained in a certain document entitled “Proposed amendment to the Town of Newtown Zoning Regulations, Accessory Uses in Residential Zones Article III Section 1, 3.01.500 – Accessory Uses” dated March 5, 2010.

SHALL BE APPROVED

BE IT FURTHER RESOLVED that the reasons for amending the regulations are as follows:

        To allow apartments for farm employees caring for horses, located in a detached         barn, accessory to a single family dwelling

BE IT FURTHER RESOLVED that the amendments are consistent with the Newtown Plan of Conservation and Development

BE IT FURTHER RESOLVED that the amendments shall become effective on April 26, 2010.

PLANNING AND ZONING COMMISSION WORKSHOP TO DISCUSS UPDATING THE TOWN OF NEWTOWN 2004 PLAN OF CONSERVATION AND DEVELOPMENT.

HAWLEYVILLE CENTER DESIGN DISTRICT

Ms. Dean distributed the following:

“Development of the Hawleyville area will follow the general uses proposed in the Interstate 84 Exit 9 Transportation Development Study of 1997 (HVCEO Bulletin 94).  This study calls for office, retail and mixed use development in several identified areas surrounding Exit 9.

To increase the density of development in this area will require extension of the sewer and water lines from Route 8 to Route 25.  The plan is to bring the sewer to (Exit 9, Barnabas Road, Hawleyville Center).  This will alow small offices, retail or special housing to be built on the south side of Route 25 and a larger corporate office or hotel to be built on the larger property on the north side of Route 25.

The center could expand its current mixed use to include residential over retail or office.  The industrial uses along Barnabas Road are fully operational at the present time.  The rail/lumber yard off Route 25 should continue at the level of use prior to the waste handling use.  The addition of waste handling in this area would preclude any additional development in the center.”

A map “Land Use Scenario = Figure 8” revised July 15, 1997 was distributed for easy reference.  Joining the discussion was Cathy Winkler, Curritick Road and Ann Marie Mitchell, 17 Butterfield Road, Newtown, Connecticut.  

Ms, Dean went through the history of the district, which at the time of the 1997 study was considered one of the most developable areas in town.  Development is limited until the sewer lines are extended.  Once a definite plan is in place the Commission will sit down with the sewer/water authority.  Mr. Benson said they should know this year what is happening with the waste handling place.  Ms. Mitchell explained her interest in the area.  She and Ms. Winkler would like to see a sustainable community and asked the Commission’s help achieving their goal.  This would concentrate on the environment, economic and human resources, making it available to everyone, benefiting the children for years to come.  The Commission suggested they come up with some sort of plan or proposal.  She submitted a letter dated April 15, 2010, which is available in the file.  

SANDY HOOK DESIGN DISTRICT

Ms. Brymer distributed an abbreviated draft introduction titled “Draft For The Sandy Hook Design District”.  There were certain things in Mr. Porco’s version that she wanted to incorporate into this, so she will revise and redistribute it at the next meeting.

Mr. Benson went through the changes with the Commission.  Some of the changes could be handled internally and others should be warned for public hearing.  He will prepare these and place them on the first possible Agenda.

Ms. Brymer moved to approve the Minutes of April 1, 2010 as submitted.  Seconded by Mr. Pozek.  The vote was unanimous

Ms. Brymer made a motion to adjourn.  Seconded by Mr. Mulholland. The vote was unanimous.
