INLAND WETLANDS COMMISSION
MINUTES
Regular Meeting of October 24, 2012 at 7:30 pm
Council Chambers, Municipal Center,

Commissioners Present:  Pat Boily, Ed Bryan, Mary Curran, Anne Peters, Katja Pieragostini, and Sharon Salling.  Staff Present:  Steve Maguire, Land Use Enforcement Officer and Tammy Hazen, Clerk

Commissioner Peters convened the meeting at 7:30 pm.

Review of the Draft Revision of Inland Wetlands and Watercourses Regulations of the Town and Borough of Newtown, Connecticut.  Steve Maguire reviewed the changes to the Town’s Inland Wetlands and Watercourse regulations that reflect DEEP updates of the CT State Statutes. The changes reflect Public Acts No. 11-5 and 11-184 (2011) and Public Act No. 12-151 (2012).  After discussion there were minor edits made.  Mr. Maguire will re-circulate a new draft to the commissioners via e-mail for review.    Commissioner Pieragostini then motioned to set a Public Hearing for November 14, 2012, which was seconded by Commissioner Salling.  The motion was approved unanimously.

NEW BUSINESS – None

ACCEPTANCE OF NEW APPLICATIONS:  IW #12-42 22 Wendover Road, Mark Edwards. Application to correct a violation.

APPROVAL OF MINUTES Commissioner Bryan motioned to approve the minutes of September 12, 2012.  Motion seconded by Commissioner Pieragostini.  The minutes were approved as written.

The commissioners and staff had a discussion regarding how amended minutes are recorded on the Town’s website.  Ms. Hazen was informed by the Town Clerk that under FOI, changes to minutes should be reflected via verbiage under the following meeting’s “Acceptance of Minutes”, but the commissioners prefer that amended minutes be posted to the website.  Commissioner Peters will discuss this with the First Selectman and gather more information from FOI.

ADJOURNMENT Commissioner Pieragostini motioned to adjourn the meeting at 8:10 pm.  Commissioner Bryan seconded the motion, which was unanimously approved.

MINUTES

Commissioners Present:  Pat Boily, Ed Bryan, Mary Curran, Anne Peters, Katja Pieragostini, and Sharon Salling.  Staff Present:  Steve Maguire, Land Use Enforcement Officer and Tammy Hazen, Clerk

Commissioner Peters convened the meeting at 8:11 pm.

Aquifer Protection Review – Referral by Planning & Zoning on application by All Star Transportation for a Special Exception to install a 5,000 gallon diesel fuel tank at 31 Pecks Lane, Newtown, CT.  

Commissioner Bryan recused himself and then became the representative for the application.  He explained that the tank is double-walled and will sit above-ground on a skid.  The commissioners reviewed a letter/report from Fuss & O’Neill (signed by Jonathan Curina, Sr. Environmental Engineer and Christopher Ecsedy, P.E., LEP) dated August 17, 2012.  After a lengthy discussion with questions from the commissioners answered by Mr. Bryan, Commissioner Salling motioned that the referral by Planning & Zoning on application by All Star Transportation for a special exception to install a 5,000 gallon diesel fuel tank at 31 Pecks Lane, Newtown, CT has been reviewed by a qualified firm and that the commission finds this application as having no significant impact.~ The motion was seconded by Commissioner Boily and unanimously approved.

Commissioner Peters requested that future referrals from P & Z be scanned and emailed to the commissioners prior to a meeting so they have time to review the information.  Ms. Hazen agreed.

ADJOURNMENT Commissioner Pieragostini motioned to adjourn at 8:32 pm.  Commissioner Bryan seconded the motion, which was unanimously approved.
