INLAND WETLANDS COMMISSION
MINUTES - Amended
Regular Meeting of October 12, 2011 at 7:30 pm
Council Chambers, Municipal Center, 3 Primrose Street, Newtown, CT

Commissioners Present:  Boily, Curran, Peters, and Salling
Staff Present:  Rob Sibley, Deputy Director of Planning and Land Use;
Steve Maguire, Wetlands Enforcement Officer, and Tammy Hazen, Clerk

Commissioner Peters convened the meeting at 7:35 pm.  

PENDING APPLICATIONS

Extension and Modification of IW Permit #08-19, 38 Taunton Hill Road.  Application by Taunton Hill Road, LLC to modify and extend current Inland Wetlands permit #08-19 for a riding arena and stable.

Atty. Peter Scalzo discussed submitted information regarding storm water maintenance plan and impervious footprint information.  After discussion, Commissioner Curran motioned to approve this application with standard conditions, A, B, C, D, E, L, and
  • The approved plans are “Accessory Equestrian Facilities”, 38 Taunton Hill Road, Newtown, CT, dated 9/13/2011 Scale 1” = 40’ with associated support documents;
  • The permit is extended until May 18, 2018
Commissioner Boily seconded the motion.  The motion was approved unanimously.

PUBLIC HEARING

IW #11-39  12-16 Pocono Road.  Application by Toll CT III Limited Partnership for Woods at Newtown, LLC for a proposed 178 unit residential elderly housing.

Commissioner Salling read the legal notice.  Matt Ranelli from Shipman and Goodwin introduced the applicant’s team; Tom Daly, PE, and Matt Sanford, MS/PWS from Milone and MacBroom; Jack Lannaman from Toll Brothers, Inc.; and Burt Dorfman, owner.  Mr. Ranelli discussed the previous applications that have been proposed for this property and handed out renderings of the current proposed site layout showing a comparative of the previously approved layout.  Mr. Daly then reviewed the rendering of the site plan and explained the buildings, topography, and wetlands.  He said the previously proposed conservation easement, the 11,000 sq ft proposed mitigation, and planting plans will remain the same, but that there are additional proposed wetland filling with mitigation.  Mr. Sanford discussed their wetland impact assessment report.  Mr. Daly discussed the architectural renderings.  

Commissioner Peters asked about the created wetlands in the northwest corner (mitigation basin).  She said while walking on the site it appeared that the basin crossed into the conservation area and if so, should it be approved by the Conservation Commission.  The applicant then explained the wetlands systems.  Commissioner Peters asked whether invasive removal plans could be incorporated into the plans.  The applicants discussed the Phragmites and reviewed their proposed treatment plan that includes an herbicide application and discussed tree and shrub plantings to increase diversity.  Mr. Sibley said that Phragmites mitigation along Route 25, using a similar herbicide, was very successful.  

Barbara Herman from Liberty at Newtown discussed how the wetlands have changed and that previously there were three separate distinct ponds where now there is one larger pond.  She felt the changes were caused by the previous developer and asked whether there will be further changes to the wetlands with this new application.    Mr. Ranelli and Mr. Sanford both said they don’t expect additional changes.  Commissioner Peters asked whether the storm water quality systems can handle the water on this site.  The applicant explained how the water moves through the site, stating that it naturally flows away from Liberty.   

Commissioner Salling motioned to close the public hearing.  Commissioner Boily seconded the motion.  The motion was approved unanimously.  The applicant will return to the next meeting.

NEW APPLICATIONS

IW #11-41  Rollingwood Subdivision Lot 88.  Application by Blakeman Construction for the construction
of a single family residence.  AND

IW #11-42  Rollingwood Subdivision Lot 103.  Application by Blakeman Construction for the construction of a single family residence.

Bill Carboni, representing both applications, provided an overhead of the subdivision, explaining specifications for these two lots.  Mr. Sibley asked if the lots were staked and discussed concerns over current water conditions on the driveway area of Lot 103.  

Mr. Carboni explained that most of the water is primarily bedrock water coming from a fissure and that when soil was removed from the bedrock, a fissure was struck.  He explained that a six inch pipe beneath the driveway would assist with the water issues.  Commissioner Peters asked if an infiltration system can be created there.  Mr. Carboni said that the area is all bedrock so there is no ability for percolation and that it will need to be piped to a natural stream.  Mr. Sibley said he noticed during the latest flood events that there are issues on Lot #105 and that perhaps it has an undersized stormwater management system.  Mr. Carboni said the inlet catch basin may be inadequate.    The commissioners will walk the site.

Approval of MinutesCommissioner Curran motioned to approve the minutes of September 28, 2011.  Motion seconded by Commissioner Salling.  The minutes were approved as written

Commissioner Boily motioned to adjourn the meeting at 8:20 pm.  Commissioner Salling seconded the motion.  The motion was approved and the meeting was adjourned.
