Commissioner Peters convened the meeting at 7:32 p.m.

Public Hearings

#09-15  William Joyce Sherman Road & Berkshire Road.  Application for a 38 lot subdivision.

Commissioner Salling recused herself.  

Larry Edwards, Pofessional Engineer, 227 Stepney Road, Easton, Connecticut went through the report of Trinkaus Engineering dated June 11, 2009 the consultant hired to examine this application.  The resulting comments were reflected in revised maps that were submitted.  He also addressed comments from the Health Department and those raised at the Conservation Commission Public Hearing.  In light of these revisions and the fact that the environmental expert had yet to make his presentation, Commissioner Peters requested an extension.

Commissioner Peters asked if there were any comments from the public.

Dan Holmes, 6 Farmery Lane, asked for the acreage and whether the land could be used for something other than developing.  He wanted to protect the water quality.  He will put his comments in writing for the file.

Marie Kitterman, 22 Sherman Street explained a vernal pool.

Margaret Soto, 4 Deerfield Drive submitted a letter for the file.                                                                                                                                                                                                                                                                      Mr. Sibley stated that an expert is being sent to the site to find out and confirm potential endangerment to wildlife.

The applicant submitted a written request to extend the hearing.

#09-22  Norman Nagy, 12, 38, 40 Cold Spring Road.  Application for restoration of a dam and the dredging of a pond

Commissioner Curran recused herself.

Larry Edwards turned the floor over to Jim McManus, JMM Wetland Consulting Services, 25 Church Street, Newtown.  Mr. McManus summarized his report that is in the file.  In his opinion there would be no direct or indirect impact to the area.  Mr. Edwards said the work should take about two weeks.  The material would be dumped on site.  He submitted plans reflecting minor changes.  They are still waiting for DEP approval.

Norman Nagy, the applicant, showed the location of the trail from the pond to the proposed dump site.  Commissioner Peters wants to make sure the wetlands are protected.  The Commission needs time to study Mr. McManus’ report.  Mr. Edwards agreed to an extension till the next meeting.

Pending Applications

#09-03  Simm Lane, LLC, 3-6 Simm Lane. Application related to the removal of a violation.  Item tabled

#09-10  Lewis & Maria Gotch, 18 Bridge End Farm Lane. Application related to the removal of a violation.  

The applicant wishes to withdraw and re-submit the application.  Commissioner Salling recommended that the outstanding $350 fine be paid and any new application would require a fee.  The Commission unanimously agreed.

#09-18  Alan Laurenco, 56 Schoolhouse Hill Road.  Application related to the removal of a violation.  Item tabled

#09-23  David & Wendy Clark, 9 Taunton Lake Road.  Application to cut down trees

Jay Fain, Environmentalist, 134 Round Hill Road, Fairfield, hired by the applicant recommended trimming and thinning the trees but leaving the ones in question up because they appear to be healthy and protect the land from erosion.  The item was tabled till the next meeting.

#09-24  Neil & Ann Marie Unger, 46 Shepard Hill Road.  Application related to the removal of a violation

Christine Unger agreed to remove the debris and provide information requested by the Commission.

#09-25  John & Alisa Farley, 6 Pond View Drive.  Application related to the removal of a violation

Alisa Farley agreed to remove the brush from the wetlands, rebuild the stone wall and plant shrubs to delineate the wetland area.

Acceptance of New Applications

#09-26  Noranda Metals Industries, 11 Prospect Drive & 40/50 Mile Hill Road South.  Application in response to DEP order to remediate contaminated groundwater.  Application accepted

#09-27  Hattertown LLC., 22 Hattertown Road.  Application accepted

Catherine Guggino, Esq., 30 Main Street, Danbury, was present representing the applicant.  This is the applicant’s third application.  The previous two are still in litigation.

Approval of Minutes - This was tabled till a future meeting


Road Ordinance – Commissioner Kotch asked if the Road Ordinance can be added to each future Agenda.

Commissioner Pieragostini motioned to adjourn at 11:40 p.m. seconded by Commissioner Kotch.  The motion was unanimously carried.
