Commissioner Peters opened the hearing at 7:30 p.m.

Violations

Pending Applications

#09-03  Simm Lane, LLC, 3-6 Simm Lane.  Application related to the removal of a violation. (Vio #06-20)

Commissioner Pieragostini read for the record a letter from Gaylan Semprebon, P.E., VP of Design Professionals, requesting a postponement until May 27, 2009 and asking for a 30-day extension.  The extension was granted.  The applicant is still working on finalizing an agreement with CL&P.  

#09-08  Art & Anne Norton, 3 Indian Hill Lane.  Application to install a stone retaining wall.
Item tabled.

#09-10  Lewis & Maria Gotch, 18 Bridge End Farm Lane.  Application related to the removal of a violation.

Atty. John Fracassini, 188 Main Street, Monroe, CT and Mr. Gotch were present.  Atty. Fracassini reviewed a timeline from the first application in 2008 to the present and asked for the violation fee to be waived.  Ann Astarita reviewed the violation file and explained the events leading up to the issuance of a violation fee.  The commissioners will walk the site.  The applicant will resubmit a map with dimensions of the buffer and mitigation area.  Mr. Sibley stated that the applicant should confirm with First Light on the activities.

#09-12  Changed to MOD #04-37  Plaza South, LLC, 266 South Main Street.  Application for the reduction of scope of existing permit (IW #04-37).  

Mike Lillis, PE, from CCA in Brookfield was present to explain revisions to an existing application.  The plans show the reduction from four buildings to three with one building's size reduced.  In lieu of the elaborate septic system previously planned, they propose a conventional septic system.  The landscaping plans have been amended showing landscape islands added in the parking lot.  The area that previously would have held the fourth building will be seeded.  Commissioners will visit the site.

#09-13  Stephen & Danielle DeGrazia, 3 Taunton Lake Drive.

Mr. DeGrazia was present to discuss a previously approved application that has lapsed.  The applicant will return with requested information and the Commissioners will visit the site.  

Other Business

Approval of Minutes – Commissioner Pieragostini motioned to approve the minutes of April 22, 2009.  Seconded by Commissioner Salling.  Motion was approved unanimously as amended.

#09-14  Town of Newtown, Cold Spring Road Bridge.  Application for the replacement of a Town bridge.
#09-15  William Joyce, Sherman Road & Berkshire Road.  Application for a 38 lot subdivision.
#09-16  Maryann & Bruce Rudolph, 165 Brushy Hill Road.  Application for a gravel driveway to rear property.
#09-17  Jeremy Frommer, 63 Taunton Lake Road.  Application related to the removal of a violation.
#09-18  Alan Laurenco, 56 Schoolhouse Hill Road.  Application related to the removal of a violation.
#09-19  Nazzaro, Inc., 310 Hammertown Road.  Application to excavate pond in Monroe near Newtown border.
#09-20  James Palmer, 18 Butternut Ridge.  Application for the construction of a detached garage.
#09-21  Janice Roman, 10 Taunton Lake Road.  Application to stabilize a stream bank.
#09-22  Norman Nagy, 12, 38, 40 Cold Spring Road.  Application to restore and dredge a pond.

PUBLIC HEARING SET:  Commissioner Curran motioned to set a public hearing for #09-15 for public hearing on June 10, 2009.  Motion seconded by Commissioner Kotch.  Motion approved unanimously.

Commissioner Pieragostini motioned to adjourn at 9:00 p.m.
