Commissioner Peters opened the hearing at 7:30 p.m.

Pending Applications

#08-63  Edward Lundblad, 155 Lakeview Terrace.  Application for removal of trees & installation of timber wall.

Mr. Lundblad was present and submitted updated plans.  No more railroad ties will be installed and vegetation will be planted.  Commissioner Curran motioned to approve the application with standard conditions A, B, and C and the approved plans include two maps dated 3/24/09.  Commissioner Pieragostini seconded the motion.  The motion was approved unanimously.

#09-02  Norman Nagy, 38 Cold Spring Road.  Application related to the removal of a violation. (Vio #08-78)

The item was tabled.

#09-03  Simm Lane, LLC, 3-6 Simm Lane.  Application related to the removal of a violation. (Vio #06-20)

Item tabled.  Commissioner Pieragostini motioned to approve a 35-day extension as requested by Galen Semprebon, P.E., of Design Professionals via letter faxed on 3/25/09. Commissioner Curran seconded the motion.  Motion carried unanimously.

#09-04  Robert Mayer, 48 Pine Tree Hill Road.  Application for the construction of a single family dwelling.

Richard Contois from L. Edwards Associates, 227 Stepney Road in Easton, CT, presented updated plans showing a split rail fence along the driveway.  The Commissioners asked for a vegetative buffer between the driveway and pond and whether a pervious driveway could be installed.  The Commission also favored plan #1 where the house would be built in the rear of the lot.  The applicant will return with updated plans showing the vegetative buffer and a partial gravel driveway.

#09-05  Sebastian DeOliveira, 119 Currituck Road.  Application related to the removal of a violation.

Mr. DeOliveira was present to discuss mitigation plans.  The erosion was stabilized and all concerns were addressed.  Pieragostini motioned to approve the application with standard conditions A, B, and C, with the approved revised plans dated 3/25/09.  Commissioner Salling seconded the motion.  Motion approved unanimously.  

Mr. DeOliveira asked to have the fees waived on this application..  Commissioner Salling motioned to waive the second fee due to difficulties with the post office.  Commissioner Pieragostini seconded the motion.  Motion approved unanimously.

#09-06  Stephen Marlin, 24 Alpine Circle.  Application related to the removal of a violation.

Alan Shepard was present to discuss plans to mitigate the wetlands in Mr. Marlin's front yard.  The wetlands will be pulled down more towards the road so that the Marlin's have a usable front yard.  Brid Craddock was also present to discuss planting plans for the wetlands.  Commissioner Salling motioned to approve the application with standard conditions A, B, C, E, and the approved plan for the development is "Wetland Restoration Plan" prepared for Steve Marlin, 24 Alpine Circle, Newtown, dated 2/26/09 and associated detail plans, and specifically landscape plan dated 2/27/09.  Seconded by Commissioner Pieragostini.  Motion carried unanimously.  

Other Business

Acceptance of New Applications

#09-07  Lynette Willie, 55 Butterfield Road.
#09-08  Art & Anne Norton, 3 Indian Hill Lane.

Commissioner Appointee - The Board of Selectmen will consider the appointment of Mr. Edward J. Bryan at their next meeting on Monday.  Upon appointment, he will then need to be sworn in.  

Approval of Minutes - Commissioner Pieragostini motioned to approve the minutes of March 11, 2009.  Seconded by Commissioner Curran.  Motion approved unanimously as amended.

Mile-a-Minute Invasive Plants - Ms. Astarita discussed a program that the Connecticut Agricultural Experiment Station is planning regarding an experiment using several types of herbicides on Mile-a-Minute weed that is on open space land along the Pootatuck River.  There will be 36 plots (6' x 10') that will be used and that will be at least 20 feet away from the water.  Their schedule was distributed.  An Inland Wetlands application will be filled out just as a simple record of the project.  All fees will be waived.  

Commissioner Pieragostini motioned to adjourn at 8:45 p.m.
