DRAFT MINUTES
Regular Meeting
October 8, 2008 7:30 p.m.
31 Pecks Lane, Newtown, Connecticut

Present:  Peters, Pieragostini, Curran and Gillingham
Staff Present: Rob Sibley, Deputy Director Land Use Agency, Tammy Hazen, Clerk

Commissioner Peters opened the hearing at 7:40 p.m.

Violations - No violations were discussed.

Public Hearing

#08-43  Michael Burton, 12, 16a, 18, 20, 20a Washington Avenue.  Application related to the construction of residential apartments.

Commissioner Pieragostini read the legal notice.  Christopher Smith, Esq. from Shipman and Goodwin, One Constitution Plaza, Hartford, summarized the application and introduced members of the team.  

Alan Shepard, Professional Engineer with Nowakowski, O’Bymachow & Kane, 415 Howe Avenue in Shelton, provided  detailed plans.  The project is 50’ away from the wetlands and the property is not in the 100 year flood plain. The buildings are four foot above the flood elevation and kept outside of the flood plain.  There will be a three foot wall around the property to demarcate the wetlands.  There is no curbing in the parking lot.  Water will drain into depressed areas, then into water quality basins and will recharge into sandy soils.  The buildings will be built on slab foundations.  They are working on the easement.  

Commissioner Curran asked about the water quality basins, catch basins and galleries.  

Jim McManus, Professional Soil Scientist with JMM Wetlands Consulting Services in Newtown, reviewed the wetlands on the property

Andy Serfilippi, Landscape Designer from Bethel, provided an outline of the landscaping plans.

Pending Applications

#08-36  Lewis Gotch, 18 Bridge End Farm Lane.  Application related to the removal of a violation.

Mr. Gotch was not present and the application is out of time.  Commissioner Gillingham motioned to deny the application as incomplete without prejudice.  Seconded by Commissioner Pieragostini.  Motion approved unanimously.  Commissioner Peters stated that the applicant should reapply before the next meeting and fees will be discussed.  

#08-38  James Walsh, 32 Berkshire Road & 4 Toddy Hill Road (abutting property).  Application for activities within a regulated area.

Steve Trinkaus, Professional Engineer from Southbury, and Atty. Rebecca Adams were present to represent the applicant.  Commissioner Pieragostini motioned to approve application with standard conditions A, B, C, and
1.      The map Development Feasibility Plan, Project #008-2008 dated October 1, 2008, prepared for J. F. Walsh, 32-34 Berkshire Road & 4 Toddy Hill Road, Newtown, Connecticut, prepared by Trinkaus Engineering, LLC.
2.      The applicant shall install markers in 40 foot increments as requested by the Commission.

Seconded by Commissioner Curran.  Motion approved unanimously.  

#08-39  William Burbank, 2 Old Green Road.  Application related to the removal of a violation.

#08-41  Barry & Tami Zorzanello, 324 Great Quarter Road.  Application related to the removal of a violation.

Tami Zoranello was present.  Commissioner Pieragostini motioned to approve this application with standard conditions A. B, & C.  Commissioner Curran seconded the motion.  Motion approved unanimously.
#08-42  Carter Dinkeloo, 163 Lakeview Terrace.  Application related to the removal of a violation.

Mr. Dinkeloo was present to discuss his application.  The commissioners will visit the site.

#08-44  Thomas & Sheila Stickles, 65 & 67 Mt. Pleasant Road.  

Mr. Stickles was present to discuss the application.  Brid Craddock will rescale the plans.  

#08-45  McEvoy, Eileen, 27 Taunton Lake Road.  Application related to the removal of a violation.

Eileen McEvoy was present to discuss the application.  The commissioners will visit the site.  Ms. McEvoy cannot make the October 22nd meeting but will attend the November 12th meeting.

Acceptance of New Applications

Minutes –September 24, 2008 Commissioner Pieragostini motioned to approve the minutes.  Seconded by Commissioner Curran.  Motion carried unanimously.

Commissioner Salling motioned to adjourn at 9:50 p.m.
