Commissioner Salling opened the hearing at 7:30 p.m.

Violations - No violations were discussed.

Pending Applications

Modification #05-42 Schultz Family Partnership, 127 Walnut Tree Hill Road & Alberts Tree Hill Road.  Application related to the modification of a subdivision Inland Wetlands Permit.

Larry Edwards, P.E., 227 Stepney Road, Easton CT, presented plans that addressed concerns previously raised.  Primary changes were listed on a letter submitted to the Commission.  Mr.  Edwards clarified the total acreage is 33.8 and discussed the crossing of an intermittent watercourse, the conservation easement and information on plantings.  

#08-12  Jody Murphy, 6 Fir Tree Lane.  Application for activities relating to the building of a single family residence.

Alan Shepard, P.E., presented the updated erosion and sedimentation control plans.  The proposed fence and buffer area were discussed as well as the stability of the slope towards the pond.  Mr.  Murphy was also present.  

#08-14  William Joyce, 12 Shepard Hill Road.  Application for activities relating to the removal of a violation.

Mr.  Joyce discussed his request to replace part of a drainage pipe and the extension of 30 feet of pipe.  It was recommended that the applicant hire a soil scientist to delineate the wetlands and to get a letter from the DEP stating the work is not under their jurisdiction.  It was suggested that Mr.  Joyce have an engineer update the plans and, because of time restraints, he should withdraw this application and reapply for another.  

#08-15  Philip Archard, 30 Zoar Road.  Application for activities within a regulated area and the dredging of a Pond.

Applicant was not present.  This item was tabled.

#08-16  David Elliot, 7 Forest View Drive.  Application related to the construction of a single family residence.

Mr.  Elliot distributed and discussed updated plans that included a rain garden and planting details.  He noted that the proposed house is farther away from the wetlands.  Commissioners will visit the site.  

#08-17  Joseph Novella, 176 Boggs Hill Road.  Application related to the construction of a single family residence.

Mark Riefenhauser, P.E.  with Smith & Company, 247 Main Street South, Woodbury, CT was present to discuss the application for the construction of a driveway and septic system.  The project will create a disturbance in the wetlands with the installation of a culvert crossing for a driveway.  The applicant will stake the property and the commissioners will visit the site.

#08-18  David & Wendy Clarke, 9 Taunton Lake Road.  Application related to the construction of a single family residence.

Alan Shepard, P.E., and Hugh Sullivan, Architect, were present to represent the applicant.  Mr.  Shepard discussed their plans to demolish an existing house and the construction of a new single family residence.  The septic system, the drilling of a new deeper well, recharge galleries and the removal of material were discussed.  The commissioners will visit the site.

#08-19  Northpoint Construction, 38 & 42 Taunton Hill Road.  Application related to the removal of a violation.

Mike Lillis from CCA, 40 Old New Milford Road, Brookfield CT; Peter Paulos, Designer, Roy Shook Associates; and Mark Guimarra, owner of Northpoint Construction, Redding, were present discuss the application.  Mr.  Paulos reviewed the plans and discussed the disturbance of wetlands originating with the clearing of an area for horses.  There are piles of wood, rock and compost.  Rocks were removed from soil and the applicant attempted to dredge a pond and modify an outlet.  The upland areas and wetlands need to be re-seeded.  The plans include a new house, an indoor riding ring and a large barn.  The roof drains, irrigation, septic system and wells were discussed.  The applicant will stake the corners of the buildings and centerline of the driveway.  The commissioners will walk the site.

Public Hearing

#08-04   Hattertown LLC, 22 Hattertown Road.  Application for activities within a regulated area.

Atty.  Ward Mazzucco provided an overview of the application.  John F.  McCoy, VII, P.E., from J.F.M.  Engineering, Inc., 440 Main Street, Ridgefield, CT reviewed the plans and addressed concerns raised in an e-mail from Mr.  Sibley and a report submitted by Mr.  McManus.  Jim McManus, Wetlands Soil Scientist with JMM Wetlands in Newtown, provided an overview of his report.  Henry Molder, Soil Scientist for the applicant addressed the commission and provided information regarding his findings.  Commissioner Salling noted that the commission will review all information and asked the applicant to consider revising plans according to the commission’s concerns.  The applicant will return on June 11, 2008.  

#08-09  Vona, Oak Ridge III, 46 Eden Hill Road.  Application for activities relating to a subdivision.

Wes Stout, Landscape Architect & Planner, 96 Main Street, New Canaan, CT, distributed updated plans and discussed a meeting the applicant’s team had with Mr.  Sibley and Mr.  McManus.

Martin Malin, P.E., Tighe & Bond, 1000 Bridgeport Avenue, Shelton, CT, presented improvements on their plans.  The fire pond will be left as a natural habitat.  He discussed storm water run-off, rain gardens, the addition of buffers and a fire storage tank and plans for a plunge pool to handle water run-off.  He noted a proposal of 31+ acres of conservation easement and 10+ acres of open space.  

Atty.  Tom Vetter submitted a letter asking for a 35 day extension.  The applicant will return on June 11th.  The public hearing will be continued.

Other Business

Minutes – April 23, 2008 Commissioner Kotch motioned to approve.  Seconded by Commissioner Clancy.  Motion carried unanimously
Minutes – May 14, 2008 Commissioner Kotch motioned to approve.  Seconded by Commissioner Curran.  Motion carried unanimously.  

Acceptance of New Applications
o       #08-20  Bruce Travis, 7 Equestrian Ridge Road.  Application related to the removal of a violation and a water diversion permit.
o       #08-21  Hoffman Landscape, 13 Equestrian Ridge Road.  Application for activities within a regulated area.
o       #08-22  Kimberly Cunningham, 34 Alpine Drive.  Application related to the removal of a violation/ installation of a driveway.
o       Mod #04-36  James Shearin, 81 Taunton Hill Road.  Modification of a previous application as a result of a violation.  

Agenda Items:  Commissioners Kotch and Pieragostini felt that the public hearings should be placed first on the Agenda.  

Additional Comments by Mr.  Sibley:

A large van will be used for transportation to the June 4th training session.
The Aquifer Protection Training Session will be held on Thursday, June 26th from 9:00 a.m.  to Noon.  There will be a second one-hour long training session for those who cannot attend the first session.  
Plan of Conservation Development meeting will be held on May 29th at 7:30 p.m.  
Also, due to an expected long agenda, Mr.  Sibley suggests that the next meeting be held earlier (7:00 p.m.) or the commission can call a special meeting to handle some of the items on the agenda.  This will be discussed with Commissioner Peters.  

Commissioner Pieragostini motioned to adjourn at 10:45 p.m.  Seconded by Commissioner Clancy.  Motion carried unanimously.
