Commissioner Peters opened the meeting at 7:30 p.m.

Pending Application

#07-22   Nunzio Sasso, 42 Great Ring Road.  Application for activities related to the mediation of an oil leak.  

Item tabled.

#07-23  Paul Genna, 32 Lake Road.  Construction of an in-ground pool and associated improvements within the wetland review limits.

Paul Genna presented information regarding plans for the construction of an in-ground pool.  The pool will be staked out on Monday.  Michael Cosmos from Pool Engineers was also present to answer any questions.  

Mr. Sibley gave a history of the violation from October 2005 for sediment and erosion control issues.  A fine of $300 was paid at the time.  The current application is for the pool and then to rectify damages caused by the violation.  Silt fence has been installed down by the lake.  Construction debris along the property line will be cleaned up as well.  Mr. Sibley stated that the commissioners will address the issues of the violation, and the level of disturbance.  The property line is recessed from the lake about 20 to 30 feet.  Mr. Sibley is in contact with Brian Wood from First Light regarding water and electricity being run down to First Light’s property.  Brian Wood from First Light has been contacted.  The applicant must receive permission for any grading of the property.  The pool installation requires retaining walls.  Commissioners will visit the site.

#07-24  27  Stephen & Paula Greenfield, 27 Parmalee Road.  Removal of dead and diseased trees within a regulated area.

Paula Greenfield was present to answer questions related to removing trees.  Commissioner Peters stated that the property looks stable and that the wetlands have been staked.  

Commissioner Curran made a motion to approve the application with standard conditions A, B and C.  Seconded by Commissioner Peters.  Application approved.

#07-25  Nick & Gina Vona,  Oak Ridge III.  Application for activities related to a subdivision

Commissioner Salling made a motion that this application be set for public hearing on September 26, 2006.  Seconded by Commissioner Gillingham.

#07-26  Mark & Theresa Valentine,  27 Bankside Trail.  Application for activities within a regulated area.

The applicant has returned with the information requested by the commission.  Commissioner Peters stated that it is not known who owns a small strip of property.  Mr. Valentine will research this.  The commission will be investigating the violation of the placement of the ‘sea wall’ built on the owner's property.  The installers (Mr. Valentine / Mr. Lundblad) will be responsible for the permit.

Commissioner Peters made a motion to approved this application with standard conditions A, B, C, E, J, K, L, and:

1.      The approved site plan is titled; “Map of Lot #27 – Mark Valentine” Block F, 27 Bankside Trail Newtown, CT Dated Revised 4-16-07
2.      The approval is for only those items listed on the application and note on the property of the applicant.
3.      The regulated activity for property owned by First Light Power Resources is approved pending proof of ownership by First Light Power Resources.  The letter of  permission provided does not establish ownership.

Commissioner Curran seconded the motion.  Motion carried.

Modification #06-47  David & Carla Barzetti, 16 Beaverdam Road.  Application for refurbishing of an existing hay barn.

Commissioner Salling motioned to approve the application with standard conditions A, B, and C and:

1.      The applicant will remove the invasive plants near the barn addition, as directed by the Conservation Official.
2.      The applicant will be restricted to install minimal improvements for access to the structure over the existing drive as directed by the Conservation Official.

Commissioner Curran seconded the motion.  Motion carried

Other Business

IW-Ext #-02-02  Porco, Glen Road.  This is not an official application for an extension, but a ruling on the status of the permit to be submitted.  

Commissioner Peters read a letter into the record from Mr. Mike Porco, dated August 16, 2007 addressed to the Newtown Wetlands Commission.  The letter is requesting an extension of IW #02-02 for a project is in the northwest corner of Sandy Hook center.  Mr. Sibley will draft a letter to the applicant requesting a status of the existing permit for the commission to review and approve.  He will speak with the town attorney.  

Hunter Ridge - Attorney Robert Hall was present to discuss an application for an extension and a possible violation of vegetation removal.  Commissioners will visit the site.  It is suggested that a surveyor confirms where the disturbance is.  It is recommended that the commission receives input from town attorney.

Acceptance of Minutes

Commissioner Salling motioned to approve minutes of August 8, 2007.  Seconded by Commissioner Peters.  Motion carried.
