Minutes of Special Meeting of June 7,  2010

Minutes of the special meeting of the Borough of Newtown Zoning Board of Appeals on June 7, 2010, at Borough Room, Town Hall South, 3 Main Street, Newtown.  Chairman John Madzula called the meeting to order at 5:30 p.m.

Present:        John Madzula, Robert Taylor, Janet Woycik and Kathy Geckle.

Absent: Bea Gellert.

Docket B10-02:  Application of St. Rose of Lima Parish for a variance to Section 5.04 of the Borough zoning regulations so as to permit the addition of modular classrooms too close to the property line.  The property is located at 40 Church Hill Road in a R-1 zone in the Borough of Newtown.

Chairman Madzula opened the public hearing at 5:30 p.m.  Mrs. Woycik read the legal notice.  Chairman Madzula said that the following members would be voting on this application:  John Madzula, Robert Taylor, Janet Woycik and Kathy Geckle.  Monsignor Weiss of St. Rose of Lima Parish was present to present the application.  He stated that enrollment in their school has increased.  They will have 479 students in the  2010-2011 school year.  He said they had researched building another building on the property but the cost was beyond their reach.  They currently have one portable trailer on the property now.  They are going to remove the playscape that is behind the building along with the one trailer  and replace it with two modular trailers (total of four classrooms).  The map that was submitted with the application does not show the addition to the school.  He said they have a 2 year lease on the trailers.  They are requesting a 16' side yard setback for one trailer and 26' side yard setback for the other trailer.  Monsignor Weiss stated that the trailers are within 75' of bathrooms which falls under the State and Diocese rules.  There was also a man named Bob, who was with Monsignor Weiss.

Chairman Madzula said that there was no one else at this hearing, therefore, there was no one to speak in favor of or against the application.  The hearing was closed.

Mrs. Geckle made a motion to approve the application of St. Rose of Lima Parish for a variance to Section 5.04 of the Borough zoning regulations so as to permit the addition of modular classrooms too close to the property line, as presented.  The motion was seconded by Mrs. Woycik and unanimously approved.

There being no further business to come before the meeting, the meeting was adjourned by the Chairman at 5:45 p.m.
