Minutes of the Meeting of January 13, 2010  

Minutes of the Meeting of the Borough of Newtown Zoning Commission on Wednesday, January 13, 2010 at the Borough Room, Town Hall South, 3 Main Street, Newtown, Connecticut.  Chairman Linda Shepard called the meeting to order at 7:25 p.m.

Present:        Linda Shepard, Douglas Nelson, David Francis, Brid Craddock, Lucy Sullivan and Alternate: Palmer Chiappetta.  Also Present:  Zoning Enforcement Officer Jean St. Jean and Borough Attorney Donald Mitchell.

Absent: None.

Public Hearing:
Application by Kung H. Wei for amendment to special exception approval to allow restaurant use on the second floor of the building and for the addition of egress stairs to  existing building on property located at 28 Church Hill Road, Newtown, CT.

Ms. Craddock read into the record the following letters from:

1.      Jennifer Hus Duckworth of Bennett Sullivan Associates dated December 15, 2009 stating that the previous approval file for the original Special Exception should be considered included with this application.
2.              Captain Joe Rios dated January 8, 2010;
3.      Fire Marshal Bill Halstead dated December 16, 2009;
4.              Conservation Director Rob Sibley dated December 21, 2009;
5.              Assistant Sanitarian Edward C. Knapik dated January 7, 2010;
6.              Chairman Lilla Dean of Newtown Planning and Zoning dated December 18, 2009.

Mr. Nelson recused himself from this application because he lives within 1,000 feet of the property that is the subject of this application.

Ms. Duckworth of Bennett Sullivan Associates was representing the applicant, Kung H. Wei.  She said that there was no change to the parking.  She said that they would be adding stairs to the back and the left side of the building.  She said that there will be a new staircase in the main entry way of the building.  The second floor will have tables and there will be exhaust fans for the hibachis.  They will either add one or two additional chimneys to the roof.  They will be adding a gable to the side of the building (Wachovia Bank side).  Mr. Bill Brunetti of 77 Butterfield Road, Newtown stated that he is the contractor for this project.  

There was no one to speak in favor or against this application.  Chairman Shepard asked if any one objected to incorporating the prior two approvals into this record.  There were no objections.  Chairman Shepard closed the hearing.

Ms. Craddock made a motion to accept the minutes of the November 17, 2009 meeting, seconded by Mr. Francis and unanimously approved.

Old Business:   
a.      Discussion and possible decisions on public hearing/application of Kung H. Wei for amendment to special exception approval to allow restaurant use on the second floor of the building and for the addition of egress stairs to  existing building on property located at 28 Church Hill Road, Newtown - Discussion took place.  Mr. Francis made a motion to approve the application of Kung H. Wei, as presented, for an amendment to special exception approval to allow restaurant use on the second floor of the building and for the addition of egress stairs to existing building on property located at 28 Church Hill Road, Newtown, CT.  The motion was seconded by Mrs. Sullivan.  The vote was unanimously approved (4-0) and the vote was as follows:

b.      Any new proposed signs – none.    
c.      Acceptance of any new applications – none.
d.      Any old business – Discussion took place regarding the banner signs at Ace Hardware.

New Business:

There being no other business to transact the meeting was adjourned at 8:45 p.m.  The next meeting is scheduled for February 10, 2010.
