SELECTMEN’S PUBLIC HEARING MINUTES
November 28, 2005
Chairman Harding opened the public hearing at 7:05pm. In attendance were Selectman John P. Ulcickas, Selectman Gary F. Nelson, Chairman Norman P. Harding and Town Administrator Nancy J. Wrigley. Minutes were transcribed and typed by Office Manager, Mary B. Winglass.
Chairman Harding announced that the Board is holding this Public Hearing per RSA 674:21 V, to adopt changes in the method of calculating school impact fees and to implement a 2005 update to the school impact fee schedule. The 2005 update to the school impact fee schedule is a result of recommended adjustments to the methodology for the assessment of impact fees based upon the most recent data of the proportionate share of the public school capital facilities of the Sanborn Regional School District.
This update was conducted by Planning Consultant, Bruce Mayberry to implement a new impact fee schedule to help recoup the cost of capital improvements provided in anticipation of the needs of new development. Impact fees may also be applied to pay existing (or future) debt service on facilities that have the capacity to provide for the needs of new development. Mr. Mayberry recommended that the fees be applied to reduce the property tax expense of future debt service on the regional high school, and/or contribute to the development or expansion of permanent elementary school facilities. It is not recommended that impact fees be used in the future to acquire more portable classrooms, or other temporary facilities.

Selectman Nelson motioned that the Board accept the Basis Of Assessment For School Impact Fees 2005 Update prepared by Bruce Mayberry effective as of November 28, 2005. Second by Selectman Ulcickas. Vote: Unanimous.
The Board then discussed that the town voted on March 8, 2005 to amend Article XXV of the Zoning Ordinance (Impact Fee Ordinance for Public School Facilities) to reflect recent changes to RSA 674:21 V with respect to the timing of assessment and to adopt changes in the method of calculating school impact fees and schedules.
The change with respect to the timing of assessment as listed on page 28 of the 2005 Newton Zoning Ordinance is as follows:
D. Assessment of Impact Fees
2. Where a subdivision or site plan approval is required for new development, impact fees shall be assessed at the time of Planning Board approval of a subdivision plat or site plan.
3. When no approval is required, or has been made prior to the adoption or amendment of the impact fee ordinance, impact fees shall be assessed prior to, or as a condition for the issuance of a building permit.
4. Impact fees shall be collected at the time a certificate of occupancy is issued. If no certificate of occupancy is required, impact fees shall be collected at the time when the development is ready for its intended use. However, the Board of Selectmen may negotiate an alternative schedule for collection with the fee payer.
5. The Board of Selectmen and the fee payer may establish an alternate, mutually acceptable schedule of payment of impact fees. In an alternate schedule of payment is established, the Board of Selectmen may require the applicant to post security, in the form of a cash bond, letter of credit, or performance bond so as to guarantee future payment of assessed impact fees.
The Board agreed to send a memo to the Planning Board and the Building Inspector stating that the Board agreed to set the alternate schedule for the collection of ALL impact fees as a condition for the issuance of a building permit. This alternate schedule will help facilitate the ease of bookkeeping and tracking of the payments. The fee payer is welcome to meet with the Board of Selectmen to discuss a mutually acceptable schedule of payment of impact fees.
