NEWTON PLANNING BOARD
MINUTES OF PUBLIC MEETING
APRIL 10, 2012

1. Call to Order: Chairman Barbara White called the meeting to order at 7:00 pm. In attendance were: Chairman Barbara White; Vice Chairman Jim Doggett; Planning Board members Frank Gibbs, Robert Miller, and Michael Blanchette; Alternate Sandra Estabrook; and BOS ex-officio Charles Melvin. Circuit Rider Planner Brian Groth was excused from the meeting. Minutes were transcribed by Administrative Assistant Rick Milner.

White appointed Estabrook to stand in for Miles.

2. Town of Newton, NH Circuit Rider Planner presentation regarding municipal costs and benefits by land use type.

White stated that, due to circuit rider planner's excused absence, the presentation would be held on a later date.
White welcomed newly elected Board member Michael Blanchette.

3. Other Board business.
a. Intent to excavate review – 185 South Main Street (Tax map 14, Block 1, Lot 24) form submitted by Stephen P. Early of SPE Real Estate, LLC.

Milner presented the intent to excavate form to the Board. He also presented correspondence from Mr. Early stating that he intends to remove material from a stockpile only. He does not intend to excavate from the ground.

Doggett moved to send a memo to the Board of Selectmen stating that the Planning Board has no concerns with the intent to excavate form for 185 South Main Street. However, if Mr. Early intends to excavate from the ground in the future, then he must apply to the Planning Board for an excavation permit. Second by Melvin. Motion carried unanimously.

b. Acceptance of minutes.
Doggett moved to accept the minutes of the March 27 meeting. Second by Gibbs. Motion carried unanimously.

c. NPREA account review – Puzzle Lane excavation (Tax Map 14, Block 1, Lot 27-4).

Milner presented the NPREA account statement for the excavation permit project in the Puzzle Lane commercial subdivision project. A recent invoice for construction observation of the site put the account into a negative balance.

Miles arrived at 7:10 pm.

Gibbs moved that the Planning Board send a certified letter to the developer stating that the NPREA account for the excavation permit project be brought to a positive balance of $500.00. Second by Doggett. Motion carried 6-0 with Miles abstaining.

White asked the Board for guidance on whether similar letters in the future needed Board review prior to mailing.

The Board came to a unanimous consensus that similar letters in the future should be reviewed by the Board prior to mailing.

Milner notified the Board that, as requested by the Planning Board, the Town Engineer and the Conservation Commission were conducting a site walk of the excavation site on April 11.

d. Sargent Woods erosion control review – Milner notified the Board that ,as requested by the Planning Board,  the Town Engineer and Lewis Builders were in the process of evaluating the amount of disturbed area within the Sargent Woods site as it relates to erosion control, stabilization , and the requirements of the project performance guarantee. The Town Engineer would report to the Board at its next meeting on April 24.

e. Milner notified the Board of several recent inquiries made to the Planning Board office regarding the cluster development ordinance, the subdivision regulations, approved use within the Village District, and accessory building regulations.

4. Adjourn: The meeting was adjourned at 7:25 pm.
