Minutes for February 21, 2013

Meeting called to order at 7:35pm.
Sandra recorded the minutes.
Old Business:
Tax Map 9, Block 6, Lot 7-1, 129 North Main St.. RTW, LLC. Open Space/Cluster, Kinsley Corner, Represented by Charles Zilch. The project consists of 29.83 acres with 150’ of roadway frontage on North Main St. and 16.02’ on Kerry Drive, located entirely in residential “A” Zone. There are several wetland areas on the site some areas are located within the aquifer protection district. The intent is to obtain approval to construct a 3 lot, open space cluster development consisting of 3 – 6 bedroom duplex dwelling to be place on the upland area. Mr. Greg Colson an abutter to the property stated that the area is very wet. He has concerns that his septic and leach field might be affected by any change in slop. Mr. Charles Zilch from S.E. Cummings &
Associates Inc. explained the proposed drainage system that the developer would be installing. There is a proposed access road that would lead to a structure for the shared well water system. Sandra asked if wet lands would be filled in to support this road. Charlie stated it will be gravel and would be close to the wet lands. Silt fence should be used to keep debris from wet areas. Peter asked if the road would be plowed in winter, as there should be no snow stored in this area and no harmful material used that could leach into the wetlands. It was not clear if this area was part of the standard dredge and fill application. Shelia mentioned that all well radiuses were not on the plan. The project will be taking advantage of the Town’s “Open Space” ordinance. Mr. Zilch said approximately 2/3 of the property is wetland, however there are two large upland areas suitable for development, only the area adjacent to North Main Street will be utilized for the three
duplexes. The remaining area adjacent to Kerry Drive will be left has “Open Space”. Jackie had concerns about the amount of trees to be cleared. Conservation felt that all natural buffers should be kept and were especially important to the lots that back up to Kerry Drive. The proposed walking trail should be made in the least harmful way to the environment. Peter asked if this would be for public use. Charlie stared it would be for the home owners. There was much discussion about the open space. Peter asked if each homeowner would be responsible for taxes on the shared areas. Mr. Zilch said yes. Jackie asked if this area would stay undeveloped. As open space Conservation felt this area should be left undisturbed and that no structure or buildings erected. The Open Space should be clearly marked on the proposed plan, and be included on any condominium agreements, deed restritions, or organizational provisions for a homeowner’s association. Peter
made a motion that a letter be sent to the Planning Board with our concerns, second by Trisha. Sandra will send the letter.

Approval of Minutes: Peter made a motion that the Minutes from the February 7, 2013 meeting be accepted, second by Pat. All in favor.
