Conservation Commission Minutes for March 19, 2009
Attendance:
Peter, Trisha, Sandy, Shelia, Pat and Nancy.
Guest: Mary Marshall
Peter called the meeting to order at 7:45pm.
Kim recorded the minutes.
Minutes Review. Peter made a motion to accept the minutes of February 5, 2009 as written. Pat Seconded. All in Favor.
Correspondence:
- DES Request for more information. Standard Dredge and Fill Application. James O’Boyle 8, Wilders Grove Road, Newton ( 2-4-37).
-Peter had visited the property on March 18, 2009. He reported that nothing had been done to the property.
2. NH Fish and Game Department- town owned water access facilities.
-Discussion. Peter filled out Application that will be returned to Mary Winglass.
- Memo from Planning Board, DTC invoice for $262.50 for services dealing with the Foy closing.
Peter made a motion to pay DTC the amount of $262.50. Nancy Seconded. All in Favor.

- 2009 Budget Expenditures – Total 3792.00 Yr-Date Exp. 89.28 (3,702.72)
- Newton Planning Board Minutes 2-10-09.
- Northeast Resource Recovery Associate- Earth Day ’09 Backyard Composting Campaign.

Peter made a motion to pay DTC $87.50. Nancy Seconded. All in Favor.
- Newton Planning Board- Pond Street Subdivision – Pond Knoll Estates.
MBL 4-5-18. Father & Son Reality Trust
-Members reviewed maps of Pond Knolls Estate. Trisha had previously been on a site walk. She reported where the proposed houses will be built is on land that is high and dry. Members reviewed our file of Pond Knolls Estate from the year 2005. Currently all of our previously requests have been met.

Other Business-
- We reviewed openings for appointments. There is one opening to become a member and three alternate positions available. Trisha knows an archeologist in town that may be interested in joining Conservation.
- Reappointments for Conservation.
Peter made a motion to accept the appointments to move Sandy and Shelia from alternates to members. Nancy Seconded. All in Favor.
Nancy made a motion to reappoint Peter Mears as Chairperson of Conservation. Pat Seconded. All in Favor.
- Resident curious on the status of 63 Peaslee Crossing. Wondering if it will be town conservation land.
- Members reviewed maps and agree that 63 Peaslee Crossing is privately owned, and is not Conservation land.
- Mary Marshall questioned if Conservation was handling easements on Georges Way and CBI, and if not who signed the easements.
Members responded to Mary’s questions, Conservation did not sign for CBI’s easement, and believes Continental Real Estate is handling it. Mary stated that since Conservation is not handling either easement than they should be taxed. Trisha reviewed the files orally. Everything had gone through DES.
Peanut Trail-
1. Members would like to go on a joint site walk with the members of
Planning Board before Bob White meets with Planning Board again. Kim will
email Planning Board to see what date works for them.
- Members discussed the numerous concerns for by Bob White to access his land locked backland.
- His land locked property is polluted with gas tanks and Jiffy Johns. We are unsure how or if the Jiffy Johns have been cleaned since he has not been granted permission to use a motorized vehicle to access his land.
- There are wetlands by the tracks.
- How many days in a row can Bob White live there without an occupancy permit?
- The Liability issues the town could face allowing Bob White to travel on town owned property.
Busch Property- Peter had mentioned some beaver damage.
