Conservation Commission Minutes for November 20, 2008  

Attendance: Peter, Trisha, Sandy, Pat, Nancy.

Guests: Bill Landry and Mary Marshall

        Peter called the meeting to order at 7:35pm.

Other Business: Bill Landry from the Newton Historical Society was present to deliver a check for the amount of $1.00 to the Conservation Commission for the purchase of the Hayford Carriage.
Bill departed at 7:45pm.

Foy/ Debitetto Proposal: Mary Marshall offered her services to act on our behalf for the Jim Foy and Mike Debitetto proposal and easement plan. Pat feels that since Mary had worked on easements in the past she is confident with her proposal. Mary will discuss the term of the easement, attorney fees not to exceed $3000.00 and the total price of the easement with Mike and Jim, along with any additional guidelines.
Peter questioned whether or not Mr. Botches and Mr. Foy’s land is in Current Use. If not this may effect tax dollars. Trisha and Mary explained how they feel that there would be little or no impact.
Pat explained that she does prefer an easement that will protect the land from other town use, preserving the land in its natural state.
Peter would like to see a full discloser for the purchase price of Scott Botches sale to Jim Foy.
Mary discussed having the easement for a period of 15 years before the Conservation Commission takes on full ownership.
Peter made a motion to grant Mary Marshall permission to be a liaison for the Conservation Commission to work with Mr. Foy and Attorney Ratigan for an easement for the property between Thornell, Quaker and Peaslee Crossing Roads. Nancy Seconded. Motion carried unanimously.
Discussion: Members discussed guidelines for Mary to follow.
1.      Cost for land- easement, $75,000.00
2.      Attorney fees not to exceed $3,000.00
3.      Building Prohibited
4.      Land for passive recreation use.
5.      Conservations right to create future trails.
Trisha and Mary departed the meeting at 8:05pm.
 
Correspondence:
1.      Rockingham Planning Commission- Legislators Forum.
2.      DES- Father and Son Reality, Alteration of Terrain Permit to disturb approximately 132,000 square feet to construct an 8 lot subdivision.
3.      Invoice from Planning Board submitting a bill from Donahue, Tucker and Ciandella for $105.00
We would like this amount taken from out legal services budget line item.
4.      Newton Planning Board Minutes, November 11, 2008.
5.      Newton Planning Board- Notice of Decision regarding Victory Fuel.
6.      2008 Budget Expenditures. Total $3250.00; Year to Date Expense $2187.76 Variance ($1062.24.)
7.      The New Right to Know Law. Reviewed.

Meeting Adjourned at 8:35pm.
