Conservation Commission Draft Minutes for October 9, 2008


Attending were:
 Peter Mears, Nancy Slombo, Sandy Estabrook, Shelia Bergeron.

Peter  called the meeting to order at 7:40pm.
Minutes Review
Peter made a motion to accept the minutes of September 18, 2008 and
October 2, 2008 as presented. Sandy Seconded. Nancy Abstained. All in Favor.

Correspondence:
1.       Board of Selectmen regarding Hayford Carriage.
Nancy made a motion to approve the sale of the Hayford Carriage to the Historical Society for $1.00 with the agreement that the Historical Society will make the carriage available for display to other town organizations. Sandy Seconded. All in Favor.
2.      Land Trust Alliance, Using the Conservation Tax Incentive, July 2008.
3.      Brochure: The Conservation Easement Handbook.
4.      NH Dept. of Resource and Economic Development, Division of Parks and Recreation.
Conservation will download application and review at the next meeting.
5.      Newton Planning Board Minutes September 23, 2008.
6.      Woodard & Curran, Summer 2008 Issue.
7.      Rockingham Planning Commission, NH Comprehensive Shoreland Protection Act, October 20, 2008.

Land Acquisition:
Members reviewed and discussed Planning Boards Technical Review Minutes regarding Mr. Foy’s and Mr. Debitetto’s Proposal.
Members reviewed document from our Attorney. The parcel was worded as an easement, however Conservation wants ownership for the land if purchased. Shelia recommended clarification from our attorney. Conservation had also had never requested for a Purchase and Sales to be drafted.
Peter made a motion to send Attorney Ratigan a letter addressing our concerns.
1.      The parcel is drafted as an easement, whereas we prefer ownership for access.
2.       We would like to clarify that we have not requested for a Purchase and Sales to be drafted.
3.      We did not agree nor ask to pay for the expense of the Title Search.
4.      We asked not to take further action until Conservations approval, and are all ready to move forward with this purchase.
Seconded by Sandy. All in Favor.
Discussion.  
Title Search and Purchase and Sales draft was not approved by the Conservation therefore it is now at the expense of the Seller.
Until these issues are addressed Conservation feels that we should not consider moving forward with this proposal.

New Business:
Peter had talked to the County Forrester regarding forest management. Some stagnant trees on town owned land may need to be cut. This would be low impact, selective cutting. The money made from the timber would go into the Conservation account to potentially buy additional land.




Other Business:
1.      For the New Year Conservation will begin working  on a management plan.
2.      Sandy made a motion for Nancy to sign Peter’s NH Permit to Trap License for all town property. Shelia Seconded. All in Favor.
