June 10, 2006 Conservation Commission Minutes
Town of Newton
Conservation Commission
P.O. Box 378
Newton, NH 03858
Minutes, Site Walk June 10th, 2006

Call to Order:

The meeting was called to order by Tricia McCarthy at 4:05 pm at the Whittier Street End of the Peanut Track.   Present were Patricia Wonson, Peter Mears, Mary Marshall, Kim Valliant and Tricia Mc Carthy.

Site Walk:
Tricia explained that the Conservation Commission had received a counter offer from Brogna and Defeo on the 34 acres of backland off the Peanut Track.   There is a stipulation that should the sale go through the land be called the John Marden Conservation Land.

It was decided that due to the rain and mosquitoes we didn’t need to walk the property as most of us have already done so.

Mary Marshall motioned, seconded by Kim Valliant, that the Commission accept the counter offer of $90,000 for 34 acres of backland off the Peanut Trail to be called the John Marden Conservation Land.   The vote was unanimous in favor with Tricia abstaining.

It should be noted that because Tricia McCarthy is officially the real estate agent for David Brogna, she is not accepting any payment for the transaction between Mr. Brogna and the Town, nor is she voting on any motions relative to the sale.

Tricia explained that there could be many weeks before the sale can be completed at the subdivision has not even been presented to the Planning Board, and that normally there would be a deposit of 5%.

Peter asked about the terms of the deposit.   Tricia told us that the deposit would be returned if the sale did not go through.

Peter motioned, seconded by Pat Wonson, to pay Mr. Brogna $4000.00 as a deposit.   Motioned carried unanimously with Tricia abstaining.

Land Acquisition:

Pat Wonson requested the Conserving Your Land book to be presented to the

Peter reported that the Country Pond Fish and Game Club has indicated that they would like some compensation for the land they had offered the town and that the are in the process of determining the value of the piece.

Adjournment:

Mary motioned to adjourn, seconded by Peter at 4:10 PM.
Motioned carried unanimously.

Respectfully submitted,

Mary Marshall, recorded
