MINUTES OF THE MEETING of March 17, 2015

CALL TO ORDER at 7:28 PM by Chairman Tom McElroy

ROLL CALL: Chairman Tom McElroy, Vice-Chairman Alan French, Bradley Cardoso,
  Jack Kozec, and Alternate Michael Connolly
Absent: Dana Allison, Alternate Ken Pelletier

Guests: Kelly Lightizer, Elizabeth Grygutis, Todd Fitzgerald, Roger Hamel, Robert Goc,  Mr. Rick Milner, (representative of the Planning Board).

Mr. Connolly was made a voting member.

ACCEPTANCE OF MINUTES:   
A motion was made by Mr. Kozec  to accept the minutes of the meeting of January 20, 2015.  Second by Mr.Cardoso.  All in favor.  Motion carries.

NEW BUSINESS:

The Applicants are seeking a variance of 80 square feet for an existing accessory apartment, over the garage of the home, that does not conform to the Town of Newton Residential A Zone Area Ordinance Section XIII, Paragraph 11- Accessory Apartments, Maximum size.

                Mr. Fitzgerald explained the request for 80 square feet, for this apartment over the garage, which had been built in 1986.  The apartment is 560 square feet, when the Ordinance would allow an accessory apartment no larger than 480 square feet. The Lightizers wish to make the existence of the apartment legal, so that they can sell the property to their daughter.  
                Discussion on Town Ordinances ensued.  The Board members wondered why this had not been grand-fathered in, since the Ordinance was included in 2008.  It was noted that accessory apartments must be attached to the current home.  The garage is attached with a breezeway, then there are stairs to go to the apartment.  The Board told the Applicants that according to the ordinance, they need to have direct access from the home to the apartment, with an inside door and a separate entrance.  This would mean the reconfiguration of the breezeway, or some other connection to make this possible.

                Mr. Kozec made a motion to continue this Hearing at the next meeting, April 21, 2015.  Second by Mr. French.  All in favor.  Motion carries.

        The Applicant is requesting a side setback variance of 11-16 feet in order to add a garage to the side of the house.  Town of Newton Residential A Zone Regulations, Section XV, Paragraph 3, Location on Lot.
        The Board reviewed and approved the plans.  Public Hearing next month, April 21, 2015.

The Applicant is requesting a variance for setbacks in order to build a front porch and steps to the house (#002-03-023-1).  
The Applicant is also requesting a variance to increase the width of the current two story garage(#002-04-018).  
Town of Newton Residential A Zone Area Regulations, Section XIV, Paragraph 3, Location on Lot.
        The Board reviewed the plans provided and scheduled the Public Hearing for the next meeting, April 21, 2015.


OLD BUSINESS:  Site-walk of the land owned by Mr. McDonough on Puzzle Lane (Map #014-  01-027-3), for the possibility of Baseball Legends coming in and constructing baseball fields, bleachers, batting cages, access roads, walkways, landscaping, drainage, other related structures, and parking.  The Board decided this site-walk would take place on Monday, March 23, 2015 at 6 PM.

ADJOURNMENT:    A motion was made at 8:40 PM by Mr. Kozec to adjourn.  Second by
Mr. French.  All in favor!   Motion carries.

Next meeting will be Tuesday, April 21, 2015 at 7:30 PM.
