MINUTES: Meeting of Tuesday, June 18, 2013

CALL TO ORDER at 7:28 PM by Chairman Tom McElroy

ROLL CALL: Chairman Tom McElroy, Jack Kozec, Bradley Cardoso,
Dana Allison, Alternate Matt Burrill                     
           Absent: Vice-Chairman Alan French, Alternate Ken Pelletier                   
             

ACCEPTANCE OF MINUTES:
Meeting of May 21, 2013.  A motion was made by Mr. Allison to accept the minutes as written.  Second by Mr.Kozec.  All in favor.  Motion carries.

Mr. Burrill made a voting member in the absence of Mr. French, making it 5 voting members.

Guests: Tony Pietrantonio, Amanda Michaud, Tony Pietrantonio III

Mr. Allison congratulated Mr. Pietrantonio on having the best proposal he’d ever seen in his 30 years working with the Board.  All members of the Board agreed.

The Board reviewed the Variance Standards (Criteria):
  • ‘contrary to the public interest’ – Board all agreed the standard was met
Spirit of the ordinance: Board voted unanimously that the condition was met
Substantial justice: All agree the condition was met
Values of surrounding properties: All in favor
Unnecessary hardship:  All agreed that the condition was met

Mr. Allison made a motion to grant all 10 variances as provided on page 4 of the Application, as recorded on Plan D-19997, the Plot Plan for 114 North Main Street, Newton, NH, dated 5-3-13, and prepared by Civil Construction Management, Inc.

THE 10 VARIANCES TO REBUILD THE HOUSE & GARAGE AT 114 NORTH MAIN STREET:
  • The proposed drip edge at the back left corner of the SFH with attached garage will be no less than 18’-10” from the poorly drained soil on the left,  (the Applicant is) seeking a 31’-2” variance at proposed back left drip edge of SFH.
  • The proposed drip edge at the front left corner of the SFH with attached garage will be no less than 30’-10” from poorly drained soil on the left, (the Applicant is) seeking a 19’-2” variance at proposed front left drip edge of SFH.
  • The proposed drip edge at the rear right corner of the SFH with attached garage will be no less than 41’-9” from the poorly drained soil on the left, (the Applicant is) seeking a 8’-3” variance at proposed rear right drip edge of SFH.
  • The proposed drip edge at the back inside corner of the SFH with attached garage will be no less than 45’-11” from the poorly drained soil on the left, (the Applicant is) seeking a 4’-1” variance at the back inside corner drip edge of SFH.
  • The proposed drip edge of the rear right corner of the garage attached to the house will be no less than 46’-6” from the poorly drained soil on the right, (the Applicant is) seeking a 3’-6” variance at rear right corner drip edge of garage.
The proposed balcony deck will extend no more than 4’-6” and be no longer than 8’-6” over the designated wetland setback area, the Applicant is seeking a variance to have a balcony deck of no more than 38.25 sqft. Over designated wetland setback area.
The proposed drip edge, of the bay window, of the SFH with attached garage will be no less than 25’-9” from the poorly drained soil (the Applicant is) seeking a 24’-3”         variance for the bay window drip edge.
The proposed septic will be no less than 50’ from the wetlands on the left, (the Applicant is) seeking a 25’ variance from the wetlands to the left of the septic.
The proposed septic will be no less than 50’ from the wetlands on the right, (the Applicant is) seeking a 25’ variance from the wetlands to the right of the septic.
The proposed septic will be no less than 52’-3” from the wetlands to the back, (the Applicant is) seeking a 22’-9” variance from the wetlands to the back of the septic.
The motion was seconded by Mr. Kozek.  The Board members voted unanimously in agreement.  Motion carries.
Chairman McElroy explained the “30 day waiting period”.
PUBLIC HEARING CLOSED.


NEW BUSINESS:
  • Discussion of the Palmer Gas offer.
  • Board of Appeals of Kingston, NH secretary’s request of information on form.    
OLD BUSINESS: No old business

ADJOURNMENT:    A motion was made at 7:43 PM by Mr. Allison to adjourn.  Second by Mr.Kozec.  All in favor!   Motion carries.
