MINUTES: Meeting of Tuesday, May 15, 2012
CALL TO ORDER at 7:30 PM by Chairman Tom McElroy
ROLL CALL: Chairman Tom McElroy, Vice-Chairman Alan French, Jack Kozec,
Dana Allison, Bradley Cardoso, & Alternate Matt Burrill
Absent: Bradley Cardoso, Alternate Matt Burrill, Alternate Ken Pelletier
ACCEPTANCE OF MINUTES:
Meeting of April 17, 2012. A motion was made by Mr. Kozec to accept the minutes as written. Second by Mr.French. All in favor. Motion carries.
PUBLIC HEARING for: MICHAEL TREADWELL
80 Wilders Grove Road
Newton, NH 03858

Mr. Treadwell explains his plans, which include the replacement of certain parts of his home, building a deck, and building the bedrooms and a new bathroom in an upstairs addition. Mr. Treadwell has all the forms needed, including the necessary State approvals and permits from the Department of Environmental Services, and the denial from the Building Inspector. The State approvals are all recorded at the Registry of Deeds.
The Board studies the proposed plans and does some measuring. Questions are asked, and answers provided.
The Board reviews the Variance Standards (Criteria):
- Not contrary to Public interest… All agree
- Spirit of ordinance observed… All agree
- Substantial justice is done… All agree (there are no ‘right of ways’ to water)
- Values of surrounding properties not diminished… All agree
- Unnecessary hardship… All agree
Mr. Allison makes a motion to grant 8 variances:
- Wetlands variance, so that the corner of the deck (on the #82 Wilders Grove Road side) can be no nearer than 23 feet to the wetlands high water line…
- Wetlands variance, so that the other corner of the deck (#78 Wilders Grove Road side) cannot be any nearer than 27 feet 5 inches from the high water line…
- No portion of the proposed deck can be any closer than 11 feet 5 inches to the side (#78 Wilders Grove Road) lot line…
- The end of deck next to the house is to be no nearer than 14 feet 9 inches (to #78)…
- That the bulkhead be no nearer than 14 feet to the side lot line (#82)…
- The end of the bulkhead is to be no nearer than 63 feet 6 inches to the center of the road…
- The corner of the proposed addition, next to the bulkhead, can be no nearer than 63 feet 10 inches…and no part of the proposed addition can be closer than 64 feet from the center line of the road…
- The proposed addition corner (next to #78 Wilders Grove) can be no closer than 19 feet 10 inches to the side lot line…

Second by Mr. Kozec. All in favor. Motion carries.
