MINUTES: Meeting of Tuesday, March 16, 2010
CALL TO ORDER at 7:30 PM by Chairman Tom McElroy
ROLL CALL: Chairman Tom McElroy, Vice-Chairman Alan French, Bradley Cardoso, Jack Kozec, & Alternate Charles Melvin, Sr.
Absent: Dana Allison, & Alternate Ken Pelletier.
Guests: Attorney John Ratigan, Robert Peterson, Augustine Medeiros
ACCEPTANCE OF MINUTES: Meeting of February 23, 2010.
Chairman McElroy pointed out an error in the title of the Moderator. All the members voted in agreement with the correction on page 2 under the ‘Old business’ section of the minutes. It should have read “Mr. Dezmelyk, Town Moderator”, and not ‘Town Administrator’. With this change, a motion was made by Mr. Kozec to accept the minutes. Second by Mr. Melvin. Motion carries.
At 7:35 PM, Mr. Kozec made a motion to recess the meeting. Mr. French seconded. All were in agreement. Motion carries.
Consultation with Legal Counsel in reference to the outstanding lawsuit:
Sara Realty, LLC v. Town of Newton Zoning Board of Adjustment
At 8:05 PM, Mr. Kozec made a motion to reconvene. Second by Mr. Melvin. Motion carries.
OLD BUSINESS: none
NEW BUSINESS: Planning & Zoning Conference to be held Saturday, May 8, 2010 at the Radisson Hotel in Nashua, NH. Board members expressed that they had already covered the offered subject material at other recent conferences.
Mr. Robert Peterson spoke to the Board, as the Intervener in the Court Case. He wished for all to know that he and Attorney Ryan had not been working together. He just needed an explanation as to procedure.
He also wanted clarification on a statement in the minutes, concerning Board members not coming to an Open Board meeting. The statement had been misinterpreted. It referred to Mr. Allison not being back from vacation and not being present at this meeting.
ADJOURNMENT: A motion was made at 8:10 by Mr. Kozec to adjourn. There was a second by Mr. French. Motion carries.
