MINUTES: Meeting of Tuesday, November 17, 2009
CALL TO ORDER at 7:30 PM by Chairman Tom McElroy
ROLL CALL: Chairman Tom McElroy, Vice-Chairman Alan French
Dana Allison, Jack Kozec, Alternates: Charles Melvin, Sr. & Ken Pelletier.
Absent: Brad Cardoso
In the absence of Mr. Cardoso, Mr. Melvin was made a voting member. All in favor.
ACCEPTANCE OF MINUTES: Meeting of October 20, 2009. A motion was made by Mr. French to accept the minutes as written. Second by Mr. Kozec. All in favor. Motion carries.
NEW BUSINESS:
- Appeal to Superior Court by Sara Realty, LLC.
Mrs. Clark reported that she had been contacted by Attorney Ratigan, of Donahue, Tucker, and Ciandella, PLLC, who will appear on behalf of the Town of Newton in this matter, and asked to put together a certified record. This had been done, and it was delivered to Attorney Ratigan’s office on Monday, November 16, 2009.
- The members of the Board reviewed the 2009 budget.
- Variance Criteria
The Board requested that Mrs. Clark take the information provided to Mr. Kozec at the Municipal Law Lecture, and prepare a form from the new information. This is to be discussed at the next meeting before adopting it.
It is necessary that we change our format again, as the new materials are to be in use by January 1, 2010.
- Members of the Board received the Schedule of meetings for the year 2010.
OLD BUSINESS:
- Municipal Law Lecture Series
The three members of the Board who attended these conferences shared the new information with the other members of the Board. Discussion.
- Variance request and e-mails (on the issue of the sign) sent to the Administrative Assistants of both the Planning Board and the Board of Appeals.
According to the Zoning Regulations of the Town of Newton, signs for Commercial undertakings in a Residential Zone can only be 2 square feet (this includes both sides, not 2 square feet on each side). (See Town Regulations
page 10). The Zoning Regulations are under the jurisdiction of the Board of Appeals. However, all of the procedures of the Board of Appeals must be followed. Then, & only then, will the Board hear the request.
- Discussion of a flyer that Chairman McElroy had received from NiceRink, on the building of an ice-skating rink in town.
- Discussion of the Workforce Housing Forum to be held by the Rockingham Planning Commission and the Workforce housing coalition on Monday, November 30, 2009, at RiverWoods at Exeter, on White Oaks Drive in Exeter.
ADJOURNMENT: A motion was made at 8:05 PM by Mr. Kozec to adjourn. Seconded by Mr.French. All in favor! Motion carries.
Next meeting to be Tuesday, December 15, 2009 at 7:30 PM.
