Chairman Pearson called the meeting to order at 7:02 p.m.
A. Meeting Minutes:
Motion: A motion was made by J. Weis and seconded by D. Powell to approve the minutes of the June 15, 2012, for the Wilshire Road site meeting as written. The motion passed unanimously.
B. Use Regulations – Light Industrial Byfield District:
Jean-Paul Beck, owner of the property at 44 Main Street, one of the parcels in the Light Industrial Byfield District, appeared before the Board to discuss a few possible revisions to the Use Regulations for the district to better address current uses and uses which could reasonably take place on the site. He requested that Light Fabrication and Machine Shop be changed from Allowed by Special Permit (SP) to Permitted (P) and that Electric Power Generation and Commercial Forestry both be Permitted (P). The Board agreed with the proposed changes with the exception of Electric Power Generation, which the Board felt should require a Special Permit.
Motion: A motion was made by J. Weis and seconded by L. McCamic to change Light Fabrication, Machine Shop, and Commercial Forestry to permitted uses in the Light Industrial Byfield District and to allow Electric Power Generation by special permit in this district and to submit these proposed zoning amendments to the Selectmen. The motion passed unanimously.
C. Wilshire Road (24-28 Rolfes Lane) Subdivision:
Mark DePiero, Steve Sawyer, and Jack Tremblay appeared before the Board to discuss landscaping proposals for the subdivision, including a detail of a new stone wall along Rolfes Lane to replace the one that was removed. J. Tremblay presented a drawing showing a section of the proposed stone wall to the Board, noting that it will be weathered fieldstone, 18” to 24” high and 18” deep, backfilled and softened with plants. The wooden ornamental fence depicted on the section will be optional for each property owner fronting on Rolfes Lane.
The design team also discussed a proposed farm gate and peastone parking area for access to the open space for mowing equipment and proposed revisions to the rain garden, including irrigation for the copper beech. The revised plan for the rain garden will be ready in about a month.
M. DePiero reported that the binder course had been installed that day and said that now that the binder and utilities are complete, he would like to request release of four lots from the covenant. The Board requested a Schedule of Values and a valuation of the lots. This will be discussed further at the next meeting.
D. Subdivision Rules and Regulations Update:
It was suggested that a working group be formed to develop the proposed changes to the Stormwater Regulations section of the Subdivision Rules and Regulations.
E. Colby Village:
D. Powell and J. O’Connell will collaborate on rewording the Warrant article regarding the acceptance of Colby Lane to clarify the status of the underground utilities.
F. Zoning Amendments for Fall Special Town Meeting:
Criteria for determining which Board should be the Special Permit Granting Authority (SPGA) for which uses were discussed; SPGA designations will be reviewed at the next meeting.
G. MIMAP:
D. Powell reported that the ACEC is now shown on MIMAP. The Board discussed obtaining a reciprocal agreement with Newburyport to share data on MIMAP, in particular water and sewer information.
On a motion made by L. McCamic and seconded by D. Powell, the meeting was adjourned at 9:59 p.m.
