John Weis, Chair, called the meeting to order at 7:02 p.m.

  • Meeting Minutes:
Motion:  A motion was made by J. O’Connell and seconded by D. Powell to approve the meeting minutes of September 18, 2013 as amended.  The motion passed unanimously.

  • ANR – 113/121 Scotland Road:
John Faria, attorney, appeared before the Board on behalf of George Carbone, Successor Trustee of the A & A Maskiewicz Trust One and A & A Maskiewicz Trust Two, to request endorsement of an ANR plan showing the division of 113 Scotland Road into two parcels: 1) Lot A to be joined to and made part of adjacent lot of A and A Maskiewicz Trust Two at 121 Scotland Road, and 2) remaining land of A and A Maskiewicz Trust One at 113 Scotland Road.  The Board found that Lot A was clearly marked on the plan to be joined to and made part of an adjacent lot and that the remaining land of A and A Maskiewicz Trust One had sufficient frontage on Scotland Road and therefore voted to endorse the plan.

Motion:  A motion was made by D. Powell and seconded by J. O’Connell to endorse as Approval Not Required the “Plan of Land, 113 Scotland Road, Assessors Map R-44 Parcel 16, Newbury, Massachusetts,” dated July 9, 2013, prepared for the Trustees of A and A Maskiewicz Trust One, 113 Scotland Road, Newbury, MA by Marchionda & Associates, L. P.  The motion passed unanimously.

  • Presentation – “The Impact of a Public Water Supply on Economic Development in the Town of Newbury, MA”:
Kathleen Pearson gave a PowerPoint presentation of her Gordon Engineering Leadership Program Challenge Project, “The Impact of a Public Water Supply on Economic Development in the Town of Newbury, MA.”  The goal of the project was to determine whether the Town could encourage economic development along Route 1 if there were a public water supply.  She explored three options:  

1) extension of the City of Newburyport’s water distribution system
2) extension of the Byfield Water District’s water distribution system
3) development of the existing wells in the Route-1 area into a new public water supply

Ms. Pearson met with the Newburyport Water Commission, the Byfield Water Commission and the property owners of the existing well locations.  Newburyport indicated that the city would not be interested in extending its system down Route 1 without a “great benefit” in return.  The Byfield Water District finds the project mutually beneficial but is not willing to fund the project.  Byfield has the water capacity to meet the demand of the project but would require an increase in the Byfield Water District’s permitted withdraw limit from DEP.    Only one of the four wells meets the DEP criteria for a public water supply.  The owner does not wish to sell his property.  

An engineering economic analysis of the three options was completed comparing the estimated cost of construction and the estimated return on investment.
The Board discussed what directions the Town might go in with this information and proposed following up with the Town Administrator.

  • Site Plan Review Subcommittee Update:
M. Taylor and K. Pearson reported that the subcommittee is continuing to review comments from other Board members and will be reviewing Site Plan Review by-laws from other communities before finalizing recommendations.

  • Revisions to Stormwater Rules and Regulations:
Some, but not all, review comments have come in.  J. O’Connell recommended that one public hearing be held on revisions to both the Stormwater Rules and Regulations and the Subdivision Rules and Regulations, ideally before the end of March.

  • 101 Newburyport Turnpike:
J. O’Connell reported on the meeting that he, Doug Packer, and M. Taylor held with Mr. Ciardiello on the site.  Mr. Ciardiello promised to clean up the site, starting with removal of the pile of RAP.  The layer of RAP that has been laid on the ground is also to be removed.  K. Pearson expressed concern that Sled Road now looks like it is part of his site.  Regular site visits will be needed to ensure that Mr. Ciardiello is following through on his promises.

  • Caldwell Farm Trail:
J. Weis reported that Jerry Ring, Chair of the Caldwell Farm HOA Board of Trustees, will appear before the Board at the November 6 meeting.

  • 67-69 Newburyport Turnpike:
For the benefit of those who were not able to attend, J. O’Connell reported on the site visit to 67-69 Newburyport Turnpike.  He also reported that test pits had been dug and that the soils are reasonable for detention.

On a motion made by J. O’Connell and seconded by D. Powell, the meeting was adjourned at 8:40 p.m.
