Conservation Commission Meeting Minutes

Present:  Chairman Packer, Jim Cunningham, Ed Deardon, John Hartnett, Les Jones, John O’Connell, Dan Streeter

There are four separate SPA Form 3 Notice of Intents divided into Areas 1-4 and lists property owners and the Town of Newbury as co-applicants for Dune Stabilazation.   GZA GeoEnvironmental has prepared the applications and Joshua Zall from GZA provided an overview of the projects which spans across Areas 1-4.  There is 2100 linear feet of bags, generally speaking they are 3x3x27 starting at Plum Island Center and moving through Areas 1-4 and ending as designated at the end of Area 4.  This project is plugged in at Army Corp Level for the initial Emergency Certificate and the 401 Water Quality Certificate.  All property owners outlined in Areas 1-4 need to sign indemnifications and the Notice of Intent signature sign-off sheet.  There will be a few items that need to be sorted through; start/stop, right of ways, dependencies, etc via a site visit and agreement of the parties within each of the areas.
There can be no gaps and no terminal ends between neighbors, unless agreed to in writing.
First of the coir bags to be inserted in the beach as a first layer can be filled with from sand on the beach; any additional material needs to be purchased to fill and cover the bags and to hold them in place.  
The Commission is waiting to hear from National Heritage; they have 30 days to respond.  NO Order of Conditions will be issued or released until all WPA Form 3 Notice of Intent signatures for submittal and indemnifications have been signed and received by the Town of Newbury Conservation Commission. When/if released, the Area Contacts will be notified.

Emergency Certification
Thomas Nee (37 Annapolis Way) – Due to damage sustained by Winter Storm Sandy, they are proposing temporary pilings as a temporary measure for extra support of dwelling.  This Emergency Certificate has been conditioned with “limit of flowable fill”.  John O’Connell moved to accept and seconded by John Hartnett.  

Other Business
Mark & Teresa Richey (10 Fordham Way) – Representative Doug Cook was not present, but asked him to come before the commission with regard to the proposed  2 sections of shadow box fencing to be installed on the coastal dune at their property.  Showed drawings provided by Mr. Cook along with explanation to Commission.  This type of fence has never been proposed and could push the limit of 50% open.   The commission would prefer that the property owner file a RDA.
