Conservation Commission Meeting Minutes
Town Hall – 25 High Road
Meeting Date – August 16, 2011 at 7:00 pm

Present: John O’Connell, Les Jones, John Hartnett, Chairman Doug Packer, Dan Streeter, Jim Cunningham

Excused: Worthen H. Taylor II

Meeting Opened: 7:02 pm

The Board was provided with and reviewed the Conservation Commission Meeting Minutes of March 15, 2011 and April 19, 2011.  There were no corrections, omissions or additions made to the minutes.  Mr. Jones made the first motion to accept the minutes of March and April 2011 and the second motion to accept was made by John Hartnett.

Leonard Dobson (38 Old Point Road) – A continued NOI to construct a two-story addition over existing deck. Mr. Dobson and the Town are still awaiting a decision by the courts, and it is recommended that this hearing be continued.  Mr. Jones made the first motion to continue the hearing to the next meeting date and the second motion was made by Mr. Cunningham.

CMF Associates, LLC (30 Northern Blvd.) – A continued NOI to construct single-family dwelling within a coastal dune.   Representative and Atty Paul Novak summarized what the status is to date for this project.  Chairman Packer again raised the Peabody and Tzitzenikos cases along with the latest status of each.  Chairman Packer reinforced the Commission’s opinion that this project must address the issues raised in both of the above cases at a minimum.  Atty Novak requested a continuance until the September 20, 2011 meeting date.

James Swallow (91 Old Point Road) – A continued NOI to construct a single-family home.  Representative Bob Watt refreshed the Commission on the project.  Mr. Watt submitted an NHESP filing and was found to be in compliance.  The project does not need to go through zoning as it is an empty log and the applicant has an as of right to build on the parcel.  There was discussion around tree or bush plantings for which there was some discussion and guidance given.  Chairman Packer asked if there were any abutters or someone in the audience who had questions, there were none.  Chairman Packer entertained a motion to close the public hearing.  Mr. Jones made the first motion to accept and Mr. Cunningham made the second motion; all in favor.

Rachel Holland (26 Old Rowley Road) – RDA to install a fence, add plantings and perform tree work.  
Ms. Holland would like to put up a fence and and do some cleanup and plantings.  The Commission requested photographs of current conditions and a plan for the proposed work.  It was asked of Ms. Holland to submit this to the Agent Doug Packer for approval.  Chairman Packer asked if there were any abutters or someone in the audience who had questions, there were none. Chairman Packer then entertained a motion to close the public hearing.  Mr. Hartnett made the first motion to accept with the approval of the plans by the Conservation Agent and Mr. Cunningham made the second motion; all in favor.

James Kraeutler (4 10th Street) – NOI to build shed next to rear west corner of the house to hold the furnace and water heater.  Representative John Riley presented an overview of the project which is just to install a 10’X10’ shed to house a furnace and water heater.  They have 910 square feet allowed and with the proposed footprint would bring them to 815 square feet.  Mr. Riley also provided photos of the existing conditions.  Chairman Packer asked if there were any abutters or someone in the audience who had questions, there were none.  Chairman Packer then entertained a motion to close the public hearing.  Mr. Cunningham made the first motion to accept and Mr. O’Connell made the second motion; all in favor.


Certificates of Compliance:
  • Jennifer Blanchet (4 Island Lane) – DEP File No. 050-984 to construct a single-family home. Chairman Packer inspected and found the project to be in substantial compliance and recommends that the Certificate be granted.  Mr. Streeter made the first motion to accept and Mr. Jones made the second motion; all in favor.
  • Norman Rubin (123 Northern Blvd) – DEP File No. 050-1062 to install fence and shell driveway.  Chairman Packer inspected and found the project to be in substantial compliance and recommends that the Certificate be granted.  Mr. Hartnett made the first motion to accept and Mr. Cunningham made the second motion; all in favor.
  • Paul Young (10 Olde Town Way) – DEP File NO. 050-1020 to replace septic system.  Chairman Packer inspected and found the project to be in substantial compliance and recommends that the Certificate be granted.  Mr. Jones made the first motion to accept and Mr. Streeter made the second motion; all in favor.

Other Business:
  • Re-Issuance of DEP File No. 050-1002 to raze and re-construct a single-family home.  Chairman Packer recommends; all in favor.
  • Issued a letter to Patrick Brennan, 195R High Road on the placement of dock and stairs on Town property.
  • New certified Vernal Pool at Boston Road and Route 1.
