Conservation Commission Meeting Minutes
Town Hall – 25 High Road
Meeting Date – September 20, 2011

Present:  Doug Packer, John O’Connell, John Hartnett, Les Jones, Jim Cunningham, Dan Streeter
Excused:  Worthen H. Taylor III

Meeting opened at 7:00 pm

Chairman Packer asked if the Board had a chance to review the minutes of May & June and if so if there any corrections or omissions; there were none.

Leonard Dobson (38 Old Point Road) – A continued NOI to construct a two-story addition over existing deck. Mr. Dobson is waiting a decision from the courts with regard to this dwelling.  Chairman Packer entertained a motion to continue the hearing until the next meeting date; Mr. O’Connell made the first motion to accept and Mr. Jones made the second motion; all in favor.

CMF Associates, LLC (30 Northern Blvd.) – A continued NOI to construct single-family dwelling within a coastal dune.  Representative Novak on behalf of his client requested continuance to the 10/18/11 meeting date.  However, the applicant’s representative did provide a locus and special permit plan to the Commission.  Mr. Jones made the first motion to accept and Mr. Hartnett made the second motion; all in favor.  

John & Christine Vogl (10 Davoli Way) – An RDA to add a staircase from the second floor deck. No additional footprint, but necessary for a second means of egress.  Applicant brought drawings of the proposed project, the Commission had no questions.  Chairman Packer asked the audience for abutters or anyone else who had any questions on the project; there were none.  Chairman Packer entertained a motion to close the public hearing.  Mr. O’Connell made the first motion to accept the project and Mr. Jones made the second motion; all in favor.

Deborah York (245 High Street) - An RDA for the replacement/upgrade of existing septic system.  
Representative John Hargraeves and Ms. York presented the new plan, there were some surrounding questions on where the existing system resides.  The BOH has approved the plan.  They brought the current systems plan and shared that they had nicked existing system when digging for pits.  They tried to position the new system without moving any large tress.  Chairman Packer first asked the Commission and then the audience for abutters or anyone else who had any questions on the project; there were none.  Chairman Packer entertained a motion to close the public hearing.  Mr. Hartnett made the first motion to accept the project and Mr. O’Connell made the second motion; all in favor.

George Finigan (6 Bryn Mawr Way) – An RDA to replace an existing fence.  The applicant provided photos showing the existing conditions, along with a drawing of the placement of the proposed fence.  It will be a combo of split rail and stockade type fencing that exists from the neighbors side of the property.  There is no dune movement, he is already backing up against an existing stockade fence which is also falling apart, along most of the path of where the new fence will be installed.  There is a solid fence to the corner of the house where the existing stockade is (noting that the existing stockade has established gardens around it and has no sand). and then with every other picket removed from there to the street..  Chairman Packer noted that they need to be sensitive to the height bylaw for the fencing as well.   

Packer & Streeter suggested opening up the fence from the street side, with every other picket being removed. Considered the staggered approach, but both from a cosmetic and ecological perspective this is not the better approach.  Chairman Packer first asked the Commission and then the audience for abutters or anyone else who had any questions on the project; there were none.  Chairman Packer entertained a motion to close the public hearing.  Mr. O’Connell made the first motion to accept the project and Mr. Streeter made the second motion; all in favor.

Josiah & Joyce Spaulding (4 40th Street) – An RDA to replace an existing chimney in-kind.  This is a direct one for one replacement, same footing, and it is surrounded by an existing deck so there will be no disturbance.  Chairman Packer first asked the Commission and then the audience for abutters or anyone else who had any questions on the project; there were none.  Chairman Packer entertained a motion to close the public hearing.  Mr. O’Connell made the first motion to accept the project and Mr. Cunningham made the second motion; all in favor.


William Ryan (18 14th Street) – An NOI to construct new front & back decks, add a second story to the back deck and improve existing driveway.  There are two side doors that will be removed.  The back deck would replace the existing porch and require footings the front deck will be re-constructed.  A second floor deck will be added over the existing footprint.  The new stairs will not cause an increase in footprint, as they will be removed from the back.  16X40 existing gravel driveway…just wants to reinforce it.  The Commission asked that the Conservation Agent go down and verify the dimensions of the driveway.  The applicant is going to plant shrubs on the landscape perimeter; these should be planted with the least amount of organics as possible.  Applicant t is going to provide what is planted, number to be planted and how planted.
Chairman Packer first asked the Commission and then the audience for abutters or anyone else who had any questions on the project; there were none.  Chairman Packer entertained a motion to close the public hearing.  Mr. Hartnett made the first motion to accept the project with the verification of the driveway size and a planting schedule and Mr. Jones made the second motion; all in favor.


Certificates of Compliance:
  • Erich Otting (32 Southern Blvd) – DEP File No. 50-530 to raze existing structure and construct a single-family home.  Chairman Packer found the project to be in substantial compliance and recommended the issuance of the Certificate.  Mr. Jones made the first motion to approve the compliance certificate and Mr. O’Connell made the second motion; all in favor.
  • Joan Sroka (75 Northern Blvd.) DEP File No. 050-846 to construct a 2-story addition to a single-family home.  Chairman Packer found the project to be in substantial compliance and recommended the issuance of the Certificate.  Mr. Jones made the first motion to approve the compliance certificate and Mr. O’Connell made the second motion; all in favor.
Extension Permit:
  • Delorey/Burns (58 Old Rowley Road) - DEP File No. 050-985.  Chairman Packer recommended the granting of the extension.  Mr. O’Connell made the first motion to approve the extension permit and Mr. Jones made the second motion; all in favor.

Other Business:

Emergency Certificate for Weasel Realty Trust – Middle Road/Adams Lane; encroachment on abutters well.  BOH Order to Correct to address the beaver dam; requirement for Conservation Commission to write an Emergency Certificate.
