BOARD OF SELECTMEN’S MEETING
JANUARY 28, 2014

Chair Joseph Story opened the meeting at 7:00 p.m. with the pledge of allegiance to our flag.   In attendance were Selectmen Story, Bear, Bulgaris, Mountain and Walker.

John Weiss, Chair of the Planning Board gave an update on the proposed zoning changes for the Annual Town Meeting.    He advised there were four issues being addressed.    A medical marijuana bylaw, incorporating the new flood hazard maps into our bylaw, changes in the site plan approval process as recommended by Counsel and Conservation assuming the responsibility for the storm water regulations.    A workshop was held on the medical marijuana bylaw and although the attendance was small there was some good input, he noted.     Where to establish a district, security, distance from a facility to sensitive receptors and the relationship to our “right to farm” bylaw and A/R district will be discussed at a public hearing to be scheduled in April to address this proposed bylaw.    Weiss was thanked for his input.

A one-day liquor license for the Newburyport Choral Society for a function at Governor’s Academy Phillips Building on March 9th (raindate March 16th) from 3-6 p.m. was approved on a motion by Selectman Bear, seconded by Selectman Bulgaris and voted unanimously.

The amended Commercial Clamming Regulations, adding Section XV-“no person shall take or have in his or her possession any shellfish less than the minimum size limit in the amount of more than five percent (5%) by count”, making it consistent with state law 322CMR, was reviewed and approved as presented on a motion by Selectman Bear, seconded by Selectman Bulgaris and voted unanimously.

A one-day liquor license for the Rowley Public Education Fund for a function at Governor’s Academy on March 15th from 6-11 p.m. was approved on a motion by Selectman Bear, seconded by Selectman Bulgaris and voted unanimously.

2014 business license renewals were approved on a motion by Selectman Bear, seconded by Selectman Mountain and voted unanimously for Lalobarun Ranch @83 Scotland Road and Tendercrop Farm @ 108 High Road.

The minutes of the January 14th meeting were accepted as presented on a motion by Selectman Bear, seconded by Selectman Mountain and voted unanimously.

A request from the American Diabetes Association’s Tour de Cure for a rest stop on the Upper Green May 18th from 8 a.m. to 12 noon was approved on a motion by Selectman Bear, seconded by Selectman Walker and voted unanimously.

Steve Fram gave a report on behalf of Linda Allen, Heidi Fram and Chris Paglia on the 2013 activities at the Byfield Community Arts Center.     The Board congratulated the center for a successful 2013.

A letter from Richard Johnson regarding plowing Myers Lane was read and discussed with input from Selectmen Mountain and Walker as past members of the Planning Board.    The matter was tabled to the next meeting to allow members time to gather more information.    The issues to resolve are should the town consider accepting a sub-standard road, plowing of private ways and possible liability.

The meeting was adjourned at 7:45 p.m. on a motion by Selectman Bear, seconded by Selectman Walker and voted unanimously.
