BOARD OF SELECTMEN’S MEETING
APRIL 22, 2014

Chairman Joseph Story opened the meeting at 7:00 p.m. with the pledge of allegiance to our flag.   In attendance were Selectmen Story, Bear, Bulgaris, Mountain, Walker and Town Administrator Tracy Blais.

Planner Martha Taylor announced that FEMA representatives are holding an open house at the NES cafeteria on Tuesday, April 29th from 5-8 p.m. to review the new flood maps and answer insurance related questions.   All affected homeowners are invited to attend.

TA Blais advised that the Snow and Ice deficit had increased slightly to $157,944.   There are also two changes to the ATM warrant; “insurance expense” projected at $159K is now anticipated to be $127,296 and the “Essex No. Shore Agricultural & Tech Assessment” has been adjusted to $62,142 due to an error in calculations by the school.   These changes were approved on a motion by Selectmen Mountain, seconded by Selectman Walker and voted unanimously.    The warrants were accepted as amended on a motion by Selectman Bear, seconded by Selectman Bulgaris and voted unanimously.

On the recommendation of Chief Reilly, Daniel Brown and Anthony Papoulias were appointed as Assistant Harbormasters on a motion by Selectman Bear, seconded by Selectman Bulgaris and voted unanimously.

A 2014 business license was renewed for Universal Visions, LLC @ 72 Newburyport Turnpike on a motion by Selectman Bear, seconded by Selectman Walker and voted unanimously.

Use of the Upper Green by North Shore Cyclists as a rest stop for their Blazing Saddles Century Ride on Saturday, August 16, 2014 was approved on a motion by Selectman Bear, seconded by Selectman Walker and voted unanimously.   James White representing NS Cyclists was asked to coordinate their activities with the Police Department and to insure all trash was removed from the Green at the conclusion of the event.

The Plum Island Beachcoma entertainment license was tabled as owner Gregg Pugh was not in attendance.    Sam Joslin, Building Inspector, updated the Board on what an entertainment license would entail for the business (sprinkling of building and ZBA special permit are two examples).    Noise would also have to be addressed and the question of cost effectiveness would need to be answered.     John Butler of National Grid noted he had an open order regarding a flood light that the owner of the Beachcoma pays for.    Numerous attempts have been made to redirect the light to please the neighbors.   He asked if the light could also be part of future discussions.   Shields are no longer available, he advised.   Butler’s suggestion was to install a regular street light which will give the owner options as to brightness.   Joslin will coordinate with the Beachcoma and Chief on these matters.    Joslin also noted he had some questions regarding one time entertainment permits and one day liquor licenses that he was addressing with Counsel.

At 7:25 p.m. the legal notice for a National Grid petition (plan #15834053) to install underground conduits from pole #2 on Hutchins Road to the property line of #6 Hutchins, at the owner’s request, was addressed.    John Butler of National Grid noted that anything owned by National Grid is marked for dig safe purposes.   It is the owner’s responsibility for everything from the property line to the dwelling.    The petition was approved on a motion by Selectman Bear, seconded by Selectman Bulgaris and voted unanimously.   Mr. Butler was thanked for his attendance.

A letter of recommendation from Chief Pearson for appointments to the Board of Fire Engineers was read by Chairman Story.    Story advised that Ed Donnelly, Doug Packer and Channing Howard had been added to this list.    Chief Pearson noted that the BOFE is made up of eight members, four from each side, which includes one Chief, two Deputy Chiefs and the rest are Captains.    There are also three Lieutenants on each side voted by their company.   Participation is the key and drop outs are replaced by a Lieutenant.   This year Terrence Martin was chosen to fill the board as he has completed all his training.    Selectman Mountain queried if the Selectmen under the Special Act could appoint an outsider.   Pearson answered yes but he could not be at fire scenes.    Selectman Walker commented that the Selectmen’s interface with the fire department has increased due to town supplied equipment and wage increases supported by the BOS and maybe a volunteer who reports to the town should be considered as a BOFE member.    After a brief discussion it was moved by Selectman Bulgaris to appoint the Chief’s recommendation of eight members and add Doug Packer to the list, seconded by Selectman Walker and voted unanimously.    Selectman Bulgaris moved to appoint the Chief’s list for Forest Wardens as presented, seconded by Selectman Bear and voted unanimously.   Doug Janvrin Jr. was appointed as EMS Coordinator on Chief Pearson’s recommendation on a motion by Selectman Walker, seconded by Selectman Bulgaris and voted unanimously.

A new business license for William Powers d/b/a Willy P. Dogs @ 86 Newburyport Turnpike was approved on a motion by Selectman Mountain and seconded by Selectman Bulgaris.   Mr. Powers advised this would be a new hot dog cart in front of Willy P. Classics.    He would serve only hot dogs, soda and chips on Thursdays, Fridays and Saturdays as an incentive for customers looking at the classic cars on the lot.     The motion was voted unanimously to approve the business license.

Erin Bligh of Dancing Goats Dairy advised she had a herd of ten dairy goats housed on Parker Street where she made soap, bath and beauty products for sale at farmer’s markets and craft fairs.    In the future she hoped to expand into goat cheese but had a long way to go with licensing for this venture.    31 Southern Boulevard would house her office only.    It was moved by Selectman Bear, seconded by Selectman Bulgaris and voted unanimously to approve the license for a (home occupation) office at 31 Southern Boulevard.

The warrant for the Town Election May 13, 2014 was approved and signed on a motion by Selectman Bear, seconded by Selectman Walker and voted unanimously.

A one-day liquor license for Protection Fire Co. #2 for a function at the Memorial Hall on May 3rd from 1:30-5:30 p.m. was approved on a motion by Selectman Bear, seconded by Selectman Bulgaris and voted unanimously.

A new business license for Michael Duffield d/b/a Newbury Kayak and Canoe @ 291 High Road (formally Fernald’s Marine) was approved on a motion by Selectman Bear, seconded by Selecvtman Bulgaris and voted unanimously.   Mr. Duffield advised he would be dealing with kayaks, canoes and paddleboards.

A one day liquor license for Matthew Coburn and North Shore Bartending for a wedding @ SPLF on May 3, 2014 from 4-10 p.m. was approved on a motion by Selectman Walker, seconded by Selectman Bear and voted unanimously.

The minutes of the April 9th meeting were accepted as presented on a motion by Selectman Bulgaris, seconded by Selectman Bear and voted unanimously.

Warrants were signed for TA Blais.

Selectman Bear advised he and TA Blais had attended the COA Volunteers luncheon last week at the Fireman’s Memorial Hall where awards were presented and a delicious lunch was served.
He also asked that congratulations be extended to Dan Maguire, Primary Operator of the Byfield Water District, who ran and completed the Boston Marathon Monday April 21st.

Chairman Story noted that he and Selectman Walker had attended the MRBA meeting Friday.   The south jetty is almost complete and monies are now available for repairs to the north jetty.    Bids are expected this fall and they are working with DCR to obtain access for the work through the Salisbury Beach Reservation.

The meeting was adjourned at 8:00 p.m. on a motion by Selectman Bear, seconded by Selectman Bulgaris and voted unanimously.
