BOARD OF HEALTH MEETING
September 16, 2014

Chair Steve Fram opened the meeting at 6:00 p.m. Present were board members Elaine Byrne, and Alba Gouldthorpe. Also present, Health Agent Deborah Rogers, and Health Inspector Virginia Bacon.

VETERANS DISCOUNT – Jason Mello, from G. Mello, Town Administrator Tracy Blais, and Newbury Resident Gene Palumbo who is a disabled veteran (100%) discussed the possibility for the Newbury Residents that are 100% disabled free of charge for their household trash.  This policy was in place in the past, and the board of selectmen would like the BOH to implement it again.  At this time, there are approximately 10 Newbury Residents that are 100% disabled Veterans.  It was moved by Alba Gouldthorpe to provide the appropriate people (100% disabled Veterans) with a trash placard, for their household trash only (no large /bulk items); it was seconded by Elaine Byrne and voted unanimously.

G.MELLO- Discussed Jason Mello’s contract renewal is coming up and possible go for 5 years instead of the 2 years.

HAZARDOUS WASTE DAY – Newbury’s Household Hazardous Waste Day event is scheduled for November 15, 2014 from 9-12 at the Newbury Elementary School.  It is a free service to the Newbury residents and open to the general public with a fee.  The Town of Georgetown usually holds a Hazardous Waste Day around the same time as Newbury, but due to the construction of the Penn Brook Elementary School, Georgetown will not be having one this year.  Georgetown will be holding their House Hold Hazardous Waste Day in the spring.  Deb Rogers proposed to the Board to allow Georgetown residents to attend Newbury’s fall HHW Day event and bill the Town of Georgetown at their fee price.  Then possibly allow Newbury Residents to attend Georgetown’s event in the spring, this would allow both towns to attend the event bi-annual rather than only once a year.  It was moved by Elaine Byrne to allow the Georgetown residents to attend the Newbury Hazardous Waste Day; it was seconded by Alba Gouldthorpe and voted unanimously.

9 MAPLE TERRACE – Matt Steinel from Millennium Engineering, requested the following variances:  1.) To reduce the required setback form cellar wall to the proposed septic tank from 10’ to 4.5’.  2.) To reduce the required setback from the garage slab to the proposed septic tank from 10’ to 3.8’.  3.) To reduce the required setback from the garage slab to the proposed pump chamber from 10’ to 5.7’.  4.) To reduce the required four foot separation between the bottom of the soil absorption system and high groundwater elevation to three feet. .  It was moved by Alba Gouldthorpe to approve the variances as written; it was seconded by Elaine Byrne and voted unanimously.

115 MAIN STREET – Robert Grasso from ELS, requested the following variances: 1.) Reduction in groundwater separation to bottom of soil absorption system from 4’ required to 3’ provided with pressure distribution system.  2.) Septic tank setback to wetlands form 25’ required to 21’ provided.  3.) Pump chamber setback to wetlands from 25’ required to 14’ provided.  4.) Soil absorption system size to 25% reduction of soil absorption system size area provided.  It was moved by Elaine Byrne to approve the variances pending Deb Rogers review and Conservation Commission approval; it was seconded by Alba Gouldthorpe and voted unanimously.

DISCUSSION:  Newbury resident Mr. Card has brought a concern to the BOH regarding the application of lime throughout Tendercrops field.  Mr. Card lives at 15 Plummers Lane and has a reaction to the lime that is being spread in the fields.  Conservation Agent, Doug Packer was asked to join us to possible see if there is a solution to lime spreading.  Mr. Card is concerned for himself and his family’s health.  When lime is spread on Tendercrop farm fields it irritates his throat, gives him a bad headache, and has difficulty breathing.  According to Mr. Card, during Labor Day weekend, the spreading of the lime caused a strong odor.  He understands that as a farmer he is allowed to spread lime but in a way that won’t affect the surrounding neighbors.  He also submitted a statement from his Labor Day weekend house guests, “foul odor, toxic and funeral like smell”.  The board would like to invite Matt the Owner of Tendercrop along with Mr. Card to see if there are some options that would satisfy both parties. Steve Fram requested the MSDS sheet from Matt.


MINUTES OF MEETING- It was moved by Alba Gouldthorpe to approve the minutes for the August 12, 2014 meeting with the correction of the word requested; it was seconded by Elaine Byrne and voted unanimously.

The next meeting of the Board of Health will be on October 14, 2014 at
6:00 p.m.
