APPROVED PUBLIC MEETING MINUTES
July 14th, 2009

Chairman Debra Jelley called a Board of Ethics meeting to order at 6:32 PM in the upper conference room of the New Durham Town Hall located off Main Street.

Approval of Minutes
Motion Bell, second Hunter, to accept the Minutes of June 9th, 2009 as written, vote unanimous.
Chair Jelley, per the last meeting request, asked if the BOE members had had an opportunity to read the Local Government Center’s publication entitled “Ethics for Land Use Board Members” and queried if there were any sections that may be relevant for revision to the BOE’s draft rules of procedure.
Mr. Fadden advised that section V “Complaints or Requests” needed to be revised to take out “or board member” with regards to exceptions to the “Right to Know” law. He stated that a board member does not enjoy the non-public protection status as cited in RSA 91-A: 3 II (c) per the booklet. All concurred.
The board continued with review of the draft “Rules of Procedure.” Further grammatical revisions ensued.
Chair Jelley quizzed her board that because of the revisions, whether or not they wished to delay approval of the “Rules of Procedure.” Mrs. Hunter opined that based on the fact that for the most part grammatical revisions only had occurred, and her sense that the clock was ticking, the rules should be affirmed.
Motion Fadden, second Hunter to adopt the “Rules of Procedure” as amended per the July 14th, 2009 meeting, vote 5 – 0. Motion carried unanimously.
In light of the vote, Mrs. Whittaker read out the proposed amendments and had the board members sign the document as amended.
Discussion ensued by the BOE for the need to have a practice session with an imaginary case to see if the rules of procedure work effectively. Mrs. Whittaker will set up a checklist and attempt to compose an imaginary complaint for a trial practice session.
Next Meeting Scheduled
The next meeting was scheduled for August 11th, 2009 at 6:30 PM in the New Durham Town Hall.
