New Durham Conservation Commission
February 23, 2010
Chairperson Cathy Allyn called the meeting to order at 7:05 PM.
Roll Call: Cathy Allyn (Chair), Terry Jarvis (Selectmen’s Representative), Bill Malay, Bob Craycraft (Alternate), Charles Berube (Vice-Chair)

Sharon Worster: The Commission reviewed the application of Sharon Worster, 4 Brightwaters Road (Map 104-008) for a Shoreland Permit to allow the construction of a garage and breezeway attached to an existing house, within the state’s protected shoreland. Commission members expressed concern about increasing the total impervious surface to more than 20% and noted the need for a variance from the New Durham Zoninig Board. They also noted that the new construction appears to be within 75’ of the shoreland which would also require a variance. They noted that the proposal does not include a maintenance plan for the proposed drywells and any other stormwater management techniques. There was also concern about the topography and hydrology of the lot and whether the constructioin
could increase drainage into the lake, particularly in terms of phosphorus loading.
The Commissiion asked staff David Allen to submit a letter to NHDES sharing the commission’s concerns.
David Harvey: The Commission reviewed the application of David Harvey for a Standard Dredge and Fill permit to allow the construction of a 38’ log stone crib dock and deck to replace a dock and deck that was destroyed by the 2008 tornado. Commission members said they were unable to tell from the information that was provided in the application if the dock and deck in place before the tornado was as large as the proposed replacement and whether it extended as far into the lake as the proposed replacement. The photographs included in the application that showed parts of the destroyed former cement deck were much smaller than the proposed new structure. Commission members also noted that the application did not include a calculation of impervious surface. They felt the
photographs also indicated a significant amount of damage to the vegetation near the lake which should be replaced in order to prevent additional erosison.
The Commision asked staff David Allen to submit a letter to NHDES asking them to request a resubmission of the application that would include at least the following:
- Calculation of impervious surface;
- Scale drawing of the lot showing the precise location and dimensions of the pre-tornado dock and deck; and showing the precise location and dimensions of the proposed new dock and deck;
- Location of pre-tornado vegetation within 15’ of the lake, indications on what vegetation was destroyed; and plans for re-vegetation;
- Any pre-tornado photographs that would give a better picture of the dock and deck before it was destroyed by the tornado.
The Commission also asked that the letter request a pre- and post-construction onsite visit from DES staff to fully understand the specific situation at this location.
Town Meeting Warrant Article: The members discussed plans for promoting and handling the warrant articles at Town Meeting that support the effort to conserve the Red Oak Ridge properties.
2010 Commission Work Plan: The Commission accepted the proposed work plan by consensus.
Minutes of January 26, 2009: Commission members made the following corrections:

Page 2, Trail Maps: correct spelling of Cathy’s name to “Allyn”; correct spelling of Kelle Chase’ name to Kelle.

Terry Jarvis moved to accept the minutes of January 26 as amended. Bill Malay seconded. Charlie Berube abstained as he was not present. Approved 4-0 with Bob Craycraft voting for Charlie Berube.
Terry Jarvis moved to adjourn the meeting at 8:47 PM. Bill Malay seconded. Approved unanimously.
