Notice of Public Hearings
Capital Improvements Program and Zoning Ordinance

Notice is hereby given of Public Hearings to be held in the New Boston Town Hall starting at 6:30 P.M. on Tuesday, December 28, 2010.  The purpose of the hearings is to consider the Capital Improvements Program and proposed amendments to the Zoning Ordinance, as follows:

PUBLIC HEARING AT 6:30 P.M. ON THE FINAL DRAFT OF THE CAPITAL IMPROVEMENTS PROGRAM, PLAN OF 2011, AS PROPOSED BY THE C.I.P. COMMITTEE.
COPIES OF THE PLAN OF 2011, TABLE II, ARE AVAILABLE at the Town Hall Planning Department free of charge, during regular business hours, are posted in the Town at TD Bank, Whipple Free Library, Post Office, Dodge's Store, Town Hall Lobby, and Planning Dept. bulletin board for viewing only, and will be available at the public hearing.

PUBLIC HEARING AT 6:45 P.M. +/- ON PROPOSED AMENDMENTS TO THE ZONING ORDINANCE BY THE PLANNING BOARD:

ARTICLE II      ESTABLISHMENT OF DISTRICTS AND DISTRICT REGULATIONS
Amend Section 204.4, "'R-A' Residential and Agricultural" to include language that would permit commercial agricultural uses that are not part of a farm to take place on the same lot as a one- or two-family dwelling, following a Special Exception and Site Plan Review.

ARTICLE II      ESTABLISHMENT OF DISTRICTS AND DISTRICT REGULATIONS
Amend Section 204.4, "'R-A' Residential and Agricultural" to add "Accessory Dwelling Unit" to the list of Permitted Uses and delete "Accessory Dwelling Unit" from the list of Special Exception Uses.

ARTICLE III     GENERAL PROVISIONS
Delete existing Section 314, Off Street Parking, and replace it with language that would describe the location of parking spaces; the number of parking spaces required for residential uses; and that would authorize the Planning Board to adopt and administer parking standards in the Non-Residential Site Plan Review Regulations.

ARTICLE III     GENERAL PROVISIONS
Delete existing Section 318, Signs, and replace it with a new section that includes a Purpose section; Definitions; a permit procedure; a method of calculating sign area; requirements for building code compliance; size and time limits for real estate development and special events signs; size, height, setback, and visibility requirements for signs in Residential, Commercial and Industrial Districts; requirements for signs not requiring a permit; and, a reference to the Selectmen's ordinance for temporary signs on Town owned property.

ARTICLE VI      DEFINITIONS
Amend the definition of "Sign" by adding reference to "No Hunting", "No Trespassing", and Historic reference signs.
Amend the definition of "Structure" to add signs to the list of items not considered a structure.
