Notice of Public Hearings
Zoning Ordinance and Building Code


        Notice is hereby given of Public Hearings to be held in the New Boston Town Hall starting at 7:00 P.M. on Tuesday, December 22, 2009.  The purpose of the hearings is to consider proposed amendments to the Zoning Ordinance, and Building Code, as follows:
        PUBLIC HEARING AT 7:00 P.M. ON PROPOSED AMENDMENTS TO THE ZONING ORDINANCE BY THE PLANNING BOARD:
ARTICLE II              ESTABLISHMENT OF DISTRICTS AND DISTRICT REGULATIONS
Add a new Section 204.10, "Workforce and Multi-Family Housing Overlay District".
ARTICLE IV              SPECIAL PROVISIONS
Section 404     Accessory Dwelling Units
Delete the requirement for a Special Exception; add language that would clarify the process for changing an existing dwelling unit to an accessory dwelling unit; and change the term "living space" to "conditioned space".    
ARTICLE III     GENERAL PROVISIONS
Section 307     Yards on Corner Lots
Delete the existing section and replace with language that would require a corner lot to have only one front yard.
Section 314     Off-Street Parking
Amend this section to prohibit parking within the front setback of a lot and only allow parking within 50% of side and rear setbacks.
ARTICLE IV              SPECIAL PROVISIONS
Section 404     Accessory Dwelling Units
Amend Section 404.3,1, to delete language that prohibits accessory dwelling units in open space subdivisions.
ARTICLE IV              SPECIAL PROVISIONS
Section 403     Personal Wireless Service Facilities
Amend Section 403.12 to require operation of a personal wireless service facility within 12 months of approval and to specify a process to request an extension.
ARTICLE VI              DEFINITIONS
Amend the definitions of "Building" and "Structure" to remove the language requiring these items to be fixed to the ground.
ARTICLE II              ESTABLISHMENT OF DISTRICTS AND DISTRICT REGULATIONS
Section 204.6   Wetlands and Stream Corridor Conservation District
Add language to Section 204.6,C,4,c,1, to allow removal of trees or limbs within the 50' vegetative buffer if they present an imminent threat to safety or property.
Section 204.1   "IND" Industrial
Replace "Newspaper and Printing" with two separate uses:  "Newspaper" and "Printing/Copying"; replace "Vehicular Sales and Repair Facility" with "Vehicular Sales Facility" and "Vehicular Repair Facility"; and, replace "Research and/or testing laboratory" with "Research & Development Facility".
Section 204.2   "COM" Commercial
Change the title of this district to "Small Scale Planned Commercial District".
Section 204.3   "R-1" Residential-One
Add Open Space Developments to the list of permitted uses.
Section 204.4   "R-A" Residential-Agricultural
Amend the Objectives and Characteristics paragraph by deleting reference to slopes over 15%; change "Cluster Residential Development" to "Open Space Development"; and, change the note regarding home businesses in Open Space Developments to refer to home occupations.
ARTICLE III     GENERAL PROVISIONS
Section 309     Driveways
Replace the word "Selectmen" with "Road Agent and/or Planning Board" as the entity that issues driveway permits.
ARTICLE VI      DEFINITIONS
Section 602     Term Definitions
Amend the definition of Agriculture to specify that the listed activities are to be operations of the farm.
ARTICLE II      ESTABLISHMENT OF DISTRICTS AND DISTRICT REGULATIONS
Section 204.7   Groundwater Resource Conservation District
Amend this section to refer to updated Aquifer maps; to add wellhead protection areas; to update the list of prohibited and permitted uses; to add a Conditional Use Permit process; to add a list of exemptions; to add performance standards; to update the definitions; to add an inspections section; to add an enforcement and penalties section; and, to add a savings clause.
COPIES OF THE FULL TEXT OF THE AMENDMENTS PROPOSED BY THE PLANNING BOARD ARE AVAILABLE at the Town Hall Planning Department free of charge, during regular business hours, are posted in the Town at TD Bank, Whipple Free Library, Post Office, Dodge's Store, Town Hall Lobby, and Planning Dept. bulletin board for viewing only, and will be available at the public hearing.

        PUBLIC HEARING AT 7:00 P.M. +/- ON PROPOSED AMENDMENTS TO THE BUILDING CODE BY THE PLANNING BOARD:
CHAPTER NB-1.5  Adoption
Amend this section to adopt the New Hampshire Building Code and associated amendments adopted by the State building code review board.
CHAPTER NB-2.0  Administrative
Amend Section NB-2.8, Plans, to require wetlands to be shown on plans submitted to the Building Inspector.
