Notice of Public Hearing
Zoning Ordinance

        Notice is hereby given of Public Hearing to be held in the New Boston Town Hall starting at 7:00 P.M. on Tuesday, January 9, 2007.  The purpose of the hearing is to consider changes and additions to the  proposed amendments to the Zoning Ordinance, as effected at the first public hearing on December 19, 2006, as follows:
        PUBLIC HEARING AT 7:00 P.M. ON PROPOSED CHANGES AND ADDITIONS TO THE AMENDMENTS TO THE ZONING ORDINANCE BY THE PLANNING BOARD:
Article II, ESTABLISHMENT OF DISTRICTS AND DISTRICT REGULATIONS
Section 204.6, Wetlands Conservation District
Delete the previously posted amendment and replace it, and the current Wetlands Conservation District, in its entirety with a new section entitled "Wetlands Conservation and Stream Corridor District".  This new section changes references throughout from "Wetlands Conservation District" to "Wetlands Conservation and Stream Corridor District"; adds reference to goals and objectives from the Master Plan; adds reference to the Piscataquog River Management Plan; changes the definition of wetlands to reference the state definition; adds a definition of perennial streams; adds a definition of vernal pool; adds an exemption for wetlands of less than 2,000 s.f. and erosion control structures; adds reference to a new "Wetlands and Stream Corridor Conservation District Map"; deletes the list of poorly and very poorly drained soils; changes reference to Certified Wetland Scientist or Certified Soil Scientist with updated definitions where necessary; changes the cost of a boundary appeal to being borne by the applicant; adds definitions of Poorly and Very Poorly Drained Soils; deletes reference to connecting piping and associated appurtenances from the setback for septic systems; adds a 50' structure setback from perennial streams, ponds, lakes or wetlands with the provision for the Planning Board to increase said setback to a maximum of 100' based on specified criteria; adds a natural woodland or vegetative buffer requirement of 50' where existing and a definition of same; includes details of how to measure the setbacks and the purposes for the setbacks; deletes the existing conflicting provisions section and replaces it at the end of the section; changes the requirement for a Special Exception from the ZBA for building a structure in the district to requiring a Conditional Use Permit from the Planning Board and updates the date for lots of record to 12/8/06; updates the "Exemption for Residential Structures" section to allow additions to one- and two-family dwellings and for septic system replacements to reflect the March 2007 town meeting date and also to require that no part of the addition be built closer to the wetland resource.

Article IV, SPECIAL PROVISIONS
Section 401, Cluster Residential Development Standards
Change the definition for affordable housing to include reference to the Single Family Mortgage Program of the NH Finance Agency; change the definition of Home Occupation by deleting reference to a business sign; adds a requirement for consultation with the Highway, Fire and Police Departments should a pavement width reduction be proposed.

COPIES OF THE FULL TEXT OF THE AMENDMENTS PROPOSED BY THE PLANNING BOARD ARE AVAILABLE at the Town Hall Planning Department free of charge, during regular business hours, are posted in the Town at TD BankNorth, Library, Post Office, Dodge's Store, Town Hall Lobby, and Planning Dept. bulletin board for viewing only, and will be available at the public hearing.
