Planning Board Meeting Minutes - 11/28/05

I.      The meeting was called to order at 6:05 p.m.

II.     The draft minutes from the November 14, 2005 meeting were unanimously approved as amended.

III.    Public Hearings -
A.      SUBDIVISION NAME: Chauncey Somes Meadow Subdivision
OWNER/APPLICANT: Caroll Fernald
        LOCATION: 6 Chauncey Somes Lane, Somesville
        TAX MAP:  10  LOT:  89  ZONE: VR2
        PURPOSE:  Public Hearing/Land Division of 1.29 acres

        It was confirmed the notice was published in the Bar Harbor Times.

        No conflict of interest was reported.  The regular members present are the voting members for this hearing.
        
        Site Inspection attended by Mrs. Jones, Mr. Clunan and Mr. Andrews and reported by Mr. Andrews. He explained that they drove down Chauncey Somes Lane and saw 3 houses on the left. The proposed lot is between the existing house one and house two. The lot is mainly open with nice trees. A drainage ditch exists on the South side of the lot. Town sewer is currently used and will continue to be utilized.

        Vice Chairman Clunan asked Mrs. Fernald to explain briefly what it is she is proposing to do? Mrs. Fernald explained that she simply wants to bisect the property in half; she is selling the second half of the property as workforce housing.

        CEO Keene explained that because the property was split 2 years ago, the Subdivision Ordinance states in Section 3.1 that any division made within 5 years of the last division must come before the Planning Board. She was asked if their was enough property there to support this split, CEO Keene explained that Mrs. Fernald needs only 20,000 square feet because of public sewer and what is proposed exceeds that requirement.




        MOTION MADE AND SECONDED TO APPROVE THE APPLICATION (Clunan/Sevigny).

        The Standards of the Subdivision Ordinance Section 5 and The Standards of Section 6. of the LUZO, as amended March 8, 2005, were reviewed and found to be in conformance, as noted on the application.

        A VOTE WAS CALLED AND THE MOTION CARRIED UNANIMOUSLY 5-0.


B.      Subdivision Name –  Arthur Palmer Trust Subdivision
OWNER/APPLICANT:– Arthur Palmer Trust, Steven Salsbury, agent
        LOCATION:       Gray Farm Road, Mt. Desert      
Map  11  Lot  69  ZONE  RW3
PURPOSE – Public Hearing/7 lot subdivision of 36.4 acres

        It was confirmed the notice was published in the Bar Harbor Times.

        No conflict of interest was reported.  The regular members present are the voting members for this hearing.

        Site Inspection attended by Mr. Andrews, Mrs. Jones and Mr. Clunan and reported by Mr. Andrews. It was explained that this property is on the Gray Farm Road the lot slightly slopes down all the way to the back and 2 residences exist. A 7 lot subdivision is proposed. There is a significant amount of open land, a farm pond and planted white pine trees. The land seems very well cared for.

        MOTION MADE AND SECONDED TO APPROVE THE APPLICATION (Jones/Clunan).
        
        The Standards of Subdivision Ordinance Section 5 and The Standards of Section 6. of the LUZO, as amended March 8, 2005 were reviewed and found to be in conformance, as follows and as noted on the application.

1.      Best Management practices will be used
2.      Proof of “non-significant” wetlands will be submitted to the Town.
3.      Clarify language on plat relating to lot numbers 3, 6 and 7.

        A VOTE WAS CALLED AND THE MOTION CARRIED UNANIMOUSLY 5-0.

IV.     Unfinished Business

        Carl Kelley was in attendance for the Great Harbor Maritime Museum to submit the
proposed wording they will be submitting to the Board of Selectman relating to the future of the building they currently reside in on Main Street. The Board was not completely sure of why it was being brought to them for proofing and explained to Mr. Kelley that they had

already submitted their letter of support for the Museum to the Town Manager and Board of Selectman. The Planning Board continues to support the Museum with their goals. No action necessary.

V.      Meeting adjourned at 8:45 p.m.  The next scheduled meeting/public hearing(s) is at 6:00 p.m., Monday, December 12 in the Meeting Room, Town Hall, Northeast Harbor.
