Planning Board Meeting Minutes - 03/14/05

I.      The meeting was called to order at 6:00 p.m.

II.     The draft minutes from the February 28, 2005 meeting were tabled for lack of a quorum.

III.    Public Hearings - Conditional Use Permits
        A.      NAME:  Beech Hill Farm  
        LOCATION:  171 Beech Hill Rd.
        TAX MAP:  9    LOT: 43 ZONE:  RW3 & SR5
        PURPOSE:  Extend days of operation; Amendment to Permit # 99-21
        SITE INSPECTION:  Not necessary

        It was confirmed the notice was published in the Bar Harbor Times.

        No conflict of interest was reported; however Chairman Sevigny reported he is an abutter to the property.  It was agreed this did not constitute a conflict of interest.  The regular members present, and alternate member Dr. Fox, are the voting members for this hearing.
        
        MOTION MADE AND SECONDED TO APPROVE THE APPLICATION (Tracy/Fox).

        Lara Judson, Assistant Farm Manager was present and explained the request to change the farm stand days from Tuesday, Thursday, and Saturday to Tuesday, Wednesday, Friday, and Saturday.  Season length and daily hours would remain the same.  Thursday is farmer’s market day in Northeast Harbor and they would like to avoid having conflicting hours.  Further discussion of operating hours prompted Mr. Tracy to suggested simply stating the extension as four days rather than defining hours.

        The Standards of Section 6. of the LUZO, as amended March 8, 2005, were reviewed and found to be in conformance, as noted on the application.

        A VOTE WAS CALLED AND THE MOTION CARRIED UNANIMOUSLY 3-0.

IV.     Unfinished Business
        A.      Mr. Tracy asked CEO Keene to follow-up on the Scott Baltz mailbox issue [used as a sign].  Now that Mr. Baltz’s mailbox is down, he suggested CEO Keene contact Mr. Baltz regarding the new enforcement issue.  He also suggested reminding Mr. Baltz not to post notices to poles.

V.      New Business
A.      Recommendations to Board of Selectmen for Planning Board members
Chairman Sevigny noted that Heather Jones and Jim Clunan would like to be re-appointed.  As far as anyone knows, there have been no applicants for the two positions being vacated by Dr. Fox and Steve Zirnkilton.  Mrs. Nolan will ask the Town Manager if anyone has applied.  Board recommended that an ad be placed in The Bar Harbor Times and The Islander requesting interested citizens to apply.

B.      Ordinance changes, discussion
        No discussion.

VI.     Meeting adjourned at 6:20 p.m.  The next scheduled meeting/public hearing(s) is at 6:00 p.m., Monday, March 28, 2005 in the Meeting Room, Town Hall, Northeast Harbor.
