I.      The meeting was called to order at 6:00 p.m. by Robert Coolidge.

II.     The draft minutes from the December 8, 2003 meeting were unanimously approved as amended.

IV.     Unfinished Business (taken out-of-order)

III.    Public Hearings - Conditional Use Permits
        A.      NAME:  Thomas R. Savage
        LOCATION:  1265 Main St, Somesville
        TAX MAP:  9     LOT:  106    ZONE:  R2
        PURPOSE:  office, storage, and fire wood processing for Savage Tree Enterprise  (Services 2 wholly enclosed)

        It was confirmed the notice was published in the Bar Harbor Times.

        No conflict of interest was reported.  The members present are the voting members for this hearing.
        
        Mr. Savage described the proposal.  It was determined that the issue of firewood is one of storage not processing, and so noted on the application.

        Site Inspection reported by Mr. Coolidge.  No signage requested.  Proposed building is setback from neighbor's property line.  Mr. Tracy complimented Mr. Savage for speaking with all of his neighbors prior to today regarding his application.

        MOTION MADE AND SECONDED TO APPROVE THE APPLICATION (Tracy/Zirnkilton).

        The Standards of Section 6. of the LUZO, as amended March 4, 2003, were reviewed and found to be in conformance, as noted on the application.

        A VOTE WAS CALLED AND THE MOTION CARRIED UNANIMOUSLY 4-0.

IV.     Unfinished Business

        Completeness Review of application

Mr. Coolidge stepped down from the Board to act in his capacity as Agent for this application.

Prior to the review of the application, Board and Mr. Coolidge reviewed the December 15, 2003 list of notes and questions.  The following was determined:
There are 5 residential/dwelling units, 1 office, and 3 commercial units.
Fees are based on units, therefore the total due is $550 (9 units @ $50 each and $100 for the application).
Five (5) Conditional Use Permit Applications are needed:  Residential use in Village Commercial Zone; Restaurant; Removal of more than 25% of trees; Height in excess of 40 feet; and Multi-family dwelling.
Impervious sidewalks are excluded from maximum lot coverage.
Lot coverage does not include roof overhangs.
Regarding wetlands, no need for documentation from a certified soil scientist.

The application was reviewed against the Subdivision Ordinance Standards as follows:

Board concluded that the application is complete (with the items noted above) and
MOTION MADE, SECONDED (Tracy/Zirnkilton), AND UNANIMOUSLY CARRIED (3-0) TO ACCEPT THE APPLICATION AS COMPLETE.

V.      New Business
        None presented

VI.     Meeting adjourned at 7:00 p.m.  The next scheduled meeting/public hearing(s) is at 6:00 p.m., Monday, January 5, 2004 in the Meeting Room, Town Hall, Northeast Harbor.
