ZBA Administrative Meeting Minutes

Hearing began at: 1:49pm
Members Present: Fred Chapman, Chair, Cynthia Weber, Clerk, Robert Lazzarini, Stanley Ross and Jonathan Levin
Also present: Joy Brown, Doug Bruce, BNRC, Jeff Purvis, Wayne Burkhart, Select Board Chair, Stanley Stanicz, Gail Lindenberg, Maggie Leonard, Planning Board Chair and Richard Comi of The Center for Municipal Solutions
The Board discussed the Planning Board meeting tomorrow night with Mark Bobrowski regarding bylaw revisions. Jon will be unable to make it and Cynthia will be late.
Joy Brown handed in a letter from the Otis Select Board to be read at the hearing at 2pm.
The Board discussed the findings from the consultant regarding the 2 cell tower hearings and whether or not they should be released in their entirety to the applicants. No one had any issues with the documents being released as is.
The Board also discussed the use of the word “waiver” in both applications and the fact that we do not have “waivers”, the requests would be considered variances to be granted. The Board felt the applicant should describe what they had in mind when using the word “waiver”. The Board discussed whether the Telecommunications Act trumps our town bylaws or not. Cynthia suggested consulting with the Berkshire Regional Planning Commission with any questions.
