Public Hearing Levy
Members Present:  Robert Gauthier, Dean Amidon, Cynthia Weber, Robert Lazzirini, Fred Chapman
The chair called the meeting to order at 3:10 p.m.
Mark Volk represented the Levy’s
Robert Lazzirini read the Notice of Public Hearing and then read the correspondence.
The Conservation Commission approved the project to rebuild
The Board of Health approved the project with the conditions that a Title V inspection be conducted of the shared septic system.
Attorney David Hellman reported that the builder, the architect, and himself were present at a scheduled meeting with the Planning Board but the Planning Board did not have a quorum so they could not make their presentation. There was no response to the BOA from the Planning Board.

Presentation
The applicant wishes to demolish a structure that was destroyed by fire and is currently uninhabitable.  They are within the provisions of 4E which provides for the rebuilding within two years.  The dwelling is 23’8” from Lake Buel, the lot size is .28A.  The dwelling is nonconforming as to frontage.   The new structure will conform to current zoning of the agricultural/residential district.  Because of the combining of two lots they no longer have the lake lot exclusion.  The new structure will be conforming. The only nonconformity is lot size and frontage.  The new structure will have a full foundation and the height will increase from 20’ to 28’.
There was no abutter input.
The evidentiary portion of the meeting was closed at 3:45
The board then discussed the findings of facts
The board then stipulated the conditions
The members voted to grant the special permit
