ZBA Hearing Minutes

Members Present: Cynthia Weber Chair, Fred Chapman, Dean Amidon, Robert Lazzarini, and Robert Gauthier (Clerk)
The board discussed the need for a second hearing covering the application of Richard Tryon due to the fact that some of the original hearing’s application paperwork and the detailed record had the incorrect address. Cynthia Weber explained that lacking proof of mailing (certified return receipts) to two of Mr. Tryon’s abutters, Town Counsel strongly recommended that the hearing be held again. The Board voted to waive the filing fee for the new hearing which will be held immediately following the WMESCO hearing on Thursday, November 15th. The board agreed that it does not need to be the same board that originally heard the new application papers with the corrected address, which will then provide corrections in the related paperwork. The Board voted unanimously to waive the
application fee for Mr. Tryon.
The Chairperson read a memo from the Select Board requesting that only the Chairperson contact Town Counsel to streamline conversations and avoid repetitive conversations. The Chairperson pointed out that the ZBA was especially concerned with adhering to the fine points of legal requirements, in order to guarantee protection to the rights of the applicants, and she believed that each member would only seek private consultation with Town Counsel when it was necessary to clarify legal interpretation. She felt that any Board member should be allowed to contact Town Counsel when needed.
Cynthia Weber stated that all members should stop into the Town Hall and get a copy of the Wireless Telecommunications bylaws prior to the WMESCO hearing in November.
The Board voted to approve payment of $60.00 for membership in the Massachusetts Federation of Planning and Appeals Boards.
The Notice of future workshops and discussions sponsored by the Citizen Planners was passed around. Especially new members were encouraged to attend as many as possible.
