ZBA Hearing Minutes

Date:  3/22/07
Hearing: Geall – 24 Carrington Battelle Rd.

Hearing began at 4:00pm.

Members Present:  Peter Murkett Chair, Fred Chapman, Robert Gauthier (Clerk), and Robert Lazzarini (Alternate)

The hearing began with Robert Gauthier, Clerk, reading the legal notice and letters from the Planning Board, Conservation Commission, and Board of Health.

Mr. Geall made his presentation to the board.  He’d like to build an addition to a non-conforming structure on a conforming lot.  The proposed two-bedroom addition to an existing one-bedroom house would be set back a minimal distance of 26 feet from the lot line. Mr. Geall understands the Board of Health’s concerns, and would be agree to remove the door from the first-floor studio

After hearing the presentation of the applicant and the written reports of the town boards, the ZBA made the following findings:

1.      The single-family dwelling is non-conforming due to structure within setback.
2.      The proposed removal of an existing attached shed will eliminate some non-conformity of structure within setback, and no proposed new construction encroaches on setback.
3.      The proposed construction would add no new non-conformity and would not increase the non-conforming nature of the single-family dwelling.

The board voted unanimously to grant the special permit with the following condition:

1.      The door separating the existing house from the new hallway leading to the studio shall be removed to address the Board of Health’s concern that the studio not be used as a bedroom.
