Minutes of the meeting of 5/19/08
Meeting Opened at: 9:00am
Select Board Members Present: Wayne Burkhart, Chairperson, Scott Jenssen and Jon Sylbert
Also in attendance for parts of the meeting: Sue Protheroe for the Monterey News, Michael Storch (Finance Committee), Stanley Ross and Raymond Tryon
The board met with the Director of Highways, Maynard Forbes and reviewed the following items:
1. Work is continuing on Curtis Rd. M. Forbes will be back at 11am to open the paving bids.
2. The advertisement for the Transfer Station bid will be in this week’s paper and the bid opening will be during the beginning of June (M. Forbes will supply the exact dates at the next Select Board meeting).
3. M. Storch mentioned that the Transfer Station attendant has been complaining to him regarding his usefulness as the attendant since the bulky waste fees aren’t being collected any longer. M. Forbes confirmed that there have been some personnel issues and that the Master Garbologist has been dealing with them.
11am: W. Burkhart, Chair closed the bid acceptance for the Curtis Road Paving Bid and read aloud the legal Invitation to Bid and the following sealed bids that were received:
· Delsignore Blacktop Paving Inc.: $83.48 unit price
· Lane Construction Corporation: $84/ton HMA base, $86/ton HMA binder, $88/ton HMA top and $26/sy Cold Plane Bridge Deck Surface and Project Ends
· LB Corporation: $74.49 unit price
· Tri-Town Paving, Inc.: $79.55 per ton
Low bid was received from LB Corporation and M. Forbes recommended accepting that bid (pending his review of the proposal submitted meeting the specifications). A motion was made to accept the bid from LB which was seconded and approved unanimously.
The board met with Fire Chief, Ray Tryon and reviewed the following items:
1. R. Tryon dropped off his recommendations for appointments to the Fire Department. The Board appointed the following people to the following positions with the Fire Department for FY09:
a. Raymond Tryon, Chief

e. Del Martin, Captain, EMT

The board met with Police Chief, Gareth Backhaus to review the following items:
1. MVA on River Rd.
2. Complaint on Art School Rd about suspicious activity – when police arrived all was found to be secure.
3. Complaint of suspicious activity on Pixley Rd near the camp. It turned out there was some old boating equipment left there by the camp with a “free” sign.
The board met with the Inter-Departmental Secretary, Melissa Noe and reviewed the following items:
1. M. Noe informed the Board that both residents that had past due false alarm fines which complaints were filed at the District Court for have been paid in full and the complaints were dropped.
The board met with Town Accountant, Barbara Gauthier to review the following items:
1. Monday is a holiday so the warrants for next week will be done on Tuesday, B. Gauthier will call the Board to come in and review and sign.
2. B. Gauthier reviewed her conversations with the Town Clerk regarding errors the Town Clerk felt were on the Town Meeting Warrant:
a. The Town Clerk felt that the monies for the Cemetery were included in the totals twice. B. Gauthier reviewed all of the numbers and found that it was not included twice.
b. The Town Clerk also had an issue with Article 1 and 2 even after an explanation from Town Counsel. B. Gauthier provided B. Swann with the email from Town Counsel and also summarized a conversation she had had prior to Town Meeting with the Department of Revenue that also advised doing it as 2 separate articles.
Miscellaneous Select Board Items Reviewed:
1. J. Sylbert summarized the school committee meeting that took place on Thursday, May 15th at Mt. Everett School. The purpose of the meeting was to discuss the future of the Monterey School for the upcoming school year. After much input from Monterey residents, the school committee declared they were not going to close the Monterey school and made arrangements to meet in sub-committee to explore possibilities for school enrollment.
2. The minutes from 5.12.08 were approved as written.
3. The Board reviewed the letter from Attorney Andrew Hochberg of Pittsfield who is representing Officer Dondey. Town Counsel has been faxed a copy of the letter and the Board contacted him during the meeting for his advice on how to handle the situation. Town Counsel is going to respond to Attorney Hochberg.
4. Memorial Day festivities: Stephanie Grotz responded to the Board that she is unable to help with the festivities so W. Burkhart offered to help with anything he can. M. Noe will order the wreaths to be picked up by J. Sylbert on Monday morning.
5. W. Burkhart spoke with the Town Clerk about the KSAMass’s complaint that they have not received their final ZBA paperwork and that the Town Clerk has not returned their calls regarding their request for the final paperwork to be filed with the Southern Berkshire Registry of Deeds. W. Burkhart felt that it wasn’t the Board’s job to prove that the Clerk wasn’t performing certain functions that her office handles and apologized that we were unable to assist the applicant in getting the documents needed. M. Noe (who is also the Zoning Board of Appeals Secretary) informed W. Burkhart that according to M.G.L. Chapter 40A Section
17 the Town Clerk must send the final paperwork to the applicant 21 days after it is filed with her office for the appeals period. The paperwork she gives to the applicant after the 21 days will certify if an appeal was filed or not. W. Burkhart felt that M. Noe might be trying to show instances when the Clerk is not doing her job when in fact M. Noe was passing along a complaint from the applicant which accompanied a plea to assist them in getting their final paperwork.
6. W. Burkhart gave a rundown of the Board of Appeals meeting that was held on Tuesday, May 13 to discuss definitions and possible changes to the Town Zoning Bylaws.
7. W. Burkhart and M. Storch gave a summary of the Broadband Committee meeting they attended.
8. M. Storch informed the Board that he has been in contact with the other Finance Committee members, the Board of Assessors and the Town Accountant to discuss getting a monthly breakdown of the Town’s expenditures in order to get a better handle on where the Town stands so that there aren’t any surprises when it comes to budget time. He has asked to Town Accountant for a 5 year history to review and look for any patterns.
9. The Board reviewed the DRAFT minutes of the Special Town Meeting and the Town Meeting which were given to the Board by the Town Clerk.
10. The Board reviewed the final Order of Conditions issued by the Conservation Commission regarding the Lake Garfield drawdown.
11. The Board continued the discussion on K. Frome’s request for the $500 allocated for I Love Monterey Day. The Board is going to respond to Ms. Frome that they can not approve “I Love Monterey Day” being scheduled for the Labor Day weekend and ask if she would like to submit another proposal with a different date. The Board also confirmed that Lakefest is scheduled to be held on August 16th.
12. The Board discussed the Annual Employee Reviews still to be done for the Highway Department, Don Torrico, Barb Gauthier, Maynard Forbes, Melissa Noe and Gareth Backhaus. The Board agreed that this year's performance reviews, being the first, would be baselines for future performance evaluations after employee goals have been articulated. The Board began completing them today for the above mentioned employees and will finish them at the next meeting.
