MONTEREY SELECT BOARD
MINUTES OF THE MEETING OF AUGUST 16, 2004


The regular weekly meeting of the Monterey Select Board was opened at 8:30 a.m. with members Jonathan Sylbert (Chair), Michèle Miller, and Michael Storch all present.

In attendance for the meeting: George Emmons of the Monterey News

·       Fire Chief Ray Tryon met with the Board to advise that there is a Fire Department scheduling conflict with the proposed September 14 date for a Special Town Meeting. The Board will determine a new date for the Special Town Meeting.

·       The Board met with Director of Operations Maynard Forbes to review Highway Department items. Forbes reported that the crew is redoing Fairview Road for the third time. Present was Bill Shein, a resident of Fairview Road. Shein raised several issues regarding Fairview Road, as follows:

o       Speeding and an increase in through traffic using the road as a shortcut: The Highway Department will post a speed limit of 25 m.p.h. on Fairview Road
o       Potential negative impact of paving: The Board advised that only a small portion of the road is to be paved, to the first house on the right
o       Drainage issues: There continues to be disagreement on drainage issues and the necessity for paving Fairview Road. Forbes admonished Selectwoman Miller for contacting the engineering firm hired by the Highway Department

In other business, Storch queried Forbes about the management of the Transfer Station, specifically, the fees charged for bulk items.

·       The Board met with Chief Gareth Backhaus to review Police Department items. Additional items discussed included the Town Offices phone system and policing issues for LakeFest.

·       The Board met with Town Clerk Barbara Swann and Deputy Town Clerk Linda Thorpe to discuss the Compensating Balance Agreement, which was not approved at the Annual Town Meeting. Swann advised that a revocation of that vote cannot be dealt with at a Special Town Meeting and requires a ballot vote at an Annual Town Meeting. It was noted that the Tax Collector salary was not increased for FY 2004-05, but the banking services provided to the Tax Collector by a CBA have been removed. Swann recommended that all fees paid to the Town, including Tax Collector filing fees, be turned over directly to the Town.

·       Robert Annelli of 80 Corashire Road met with the Board to express his interest in being appointed to the office of Inspector of Animals. The Board advised that the

term of the current inspector does not expire until June 30, 2005; however, Annelli was encouraged to submit a letter of interest for future appointment.

·       The Board met with LakeFest Coordinator Janet Cathcart to discuss several items, as follows:

o       Contract with Berkshire Fireworks:
1.      Board asked that the following be added: Berkshire Fireworks is not allowed to drive any vehicles onto the dam or damage the dam in any way
2.      The Board asked that the contract sentence regarding security state that the barriers will remain in place until Berkshire Fireworks has cleaned up the area the next morning (current contract requires Town to provide security for Berkshire Fireworks equipment until dawn)
3.      Clarification of contract language regarding parking
4.      Licensing requirement for two display operators
o       Parking attendants: The Board advised that the Police Department cannot help with parking

·       The Board met with Administrative Assistant Bonnie Tedder to review Town Office items.

·       Highway and Treasury Warrants were signed.

·       The clerk was given instructions regarding correspondence.

·       The Minutes of August 9, 2004, were approved as written.

·       It was unanimously voted that the meeting be adjourned (11:50 a.m.).
