Planning Board minutes for April 28, 2016
The meeting was called to order at 7:15 p.m.
Members present: Stephen Enoch, co-chair, Maggie Leonard, co-chair, Roger Tryon, Larry Klein, Pat Salomon, and Tom Sawyer, clerked.
There was no business from the public.
The board read the minutes from the March 31, 2016, public hearing and they were approved as written. The board read the minutes from the March 31, 2016, Planning Board meeting and they were approved as written.
The board discussed the presentation of the SDU zoning bylaw proposal at the Annual Town Meeting. Discussion covered potential questions and concerns that people may have, as well as reviewing our supporting facts and documents.
The board reviewed an application for a special permit submitted by Brenner of 42 Elephant Rock Road. The public hearing is scheduled for May 12, 2016. The board made the following findings of fact:
- The property is in the lakeshore district.
- The dwelling on the property is in the 40’ setback from Lake Garfield.
- The dwelling on the property is in the 15’ side setback area.
- The applicants seek to expand by cantilevering over the setback areas in order to not change the footprint and to not disturb the soil in the setbacks.
- The Planning Board voted unanimously that the proposed construction would increase the non-conforming nature of the dwelling.
The board opened the mail.
- Notice from Tyringham for a special permit hearing for the construction of a deck on Lake Side Drive.
- Great Barrington notice of a public hearing for a new freestanding sign.
