Planning Board minutes for Thursday September 24, 2015
The meeting opened at 7:05.
I. Members present: Pat Salomon, Alan Salamon, Larry Klein, Maggie Leonard, co-chair, Roger Tryon, Tom Sawyer, (notes) and Stephen Enoch, co-chair.
II. Public present: Kenn Basler and Patrick McColgan from Taconic Land Consultants.
III. Co-chair Leonard alerted the board and McColgan that the agenda item to review the Timledge Form A plan was being tabled due to a complaint from an abutter about the short notice of the meeting (the meeting was posted 48 hours in advance as legally required) and that the meeting too close to Yom Kippur which prevented this person from attending the meeting. McColgan stated that abutters have no vote or say in the process of a Form A and that their attendance was immaterial. Leonard stated that to be fair the item would be tabled until the next meeting. The item was tabled and the plan was not reviewed.
IV. The minutes for September 10, 2015 were approved as written.
V. The board reviewed the finding for the special permit application for Germain of 70 Tyringham Road. The board voted to delete the last sentence of the finding and approved sending it to the ZBA for the hearing on September 29.
VI. The Board discussed a list of items for ADU bylaw proposal.
- Discussion on how or if to make the ADU subordinate by limiting the square footage or by limiting the number of bedrooms.
- Discussion on revisiting the goals of the bylaw.
- Discussion about the nature and the number of lots in Monterey.
- 50% of the houses are nonconforming (mostly around the lake)
- 521 lots less than 2 ac
- 791 greater than 2 ac
- There are 849 dwelling units in Monterey
- We need to have a count of the possible lots for the town meeting
- The board needs to make sure that we are not changing the 2-acre zoning unless that is the intent.
- We are not creating two lots that could be sold separately.
- Discussion about Air BNB and VRBO rentals relative to ADU’s.
- Vote on the language of 1000 sq. feet as a maximum passed
- Vote on language of number of bedrooms. Vote to restrict to one Bedroom was passed??
- Vote to remove the language of Percentage of the Primary passed
- Vote on Proximity to the primary dwelling it was agreed that it should be included.
- We will discuss the proximity definition at the next meeting.
The board discussed a noise ordinance and agreed that this would be a Town Bylaw and not a Zoning Bylaw. We noted that the Building Commissioner enforces the Zoning Bylaws and that the Monterey Police would be responsible for enforcing a noise ordinance. Not sure if this is an issue for the Planning Board to tackle.
